CTX9000 Probe Panel to Submit Report for Final AEC Consideration on Monday

The Assets Examination Committee is set to conclude its years-long investigation into the irregularities surrounding the CTX bomb scanners by next Monday.

Assets Examination Committee (AEC) spokesperson Sak Korsaengruang expects the AEC sub-committee charged with the probe into the scandalous CTX 9000 bomb scanner purchase to draw its conclusion and submit the report to the main panel by Monday.

The sub-committee has drawn a preliminary conclusion that the baggage scanners have been bought at a much inflated price and the purchase contract made through GE Invision Company in the U.S. was specifically carried out to pave the way for the rigged purchase.

It also stated that former Prime Minister Thaksin Shinawatra’s and former Transport Minister Suriya Jungrungreangkit’s denial of their alleged intervention into the purchase process has been weak as the sub-committee has obtained a number of documents which proved their involvement since 2001.

All the details compiled by the sub-committee are expected to be passed to the AEC main panel on Monday, before the case is submitted to the court for further consideration.

Graft-Busters to Look at CTX900 Scanner Purchase Scandal Today

The Assets Examination Committee is poised to conclude its year-long probe into the Suvarnabhumi baggage scanner purchase today before submitting the case to court.

The Assets Examination Committee (AEC) is scheduled this afternoon to consider the conclusions of an investigative sub-committee chaired by Amnuay Thantara on the irregularities surrounding the purchase of CTX 9000 bomb scanners under the Thaksin Shinawatra administration.

The sub-committee spent almost 10 hours last Friday to debate the case but could not reach a conclusion and continued the meeting on Saturday. They met again this morning to wrap up the probe before presenting the report to the graft-buster’s main panel later today.

The sub-committee has drawn a preliminary conclusion that the baggage scanners were bought at a much inflated price and the purchase contract made through GE Invision Company in the U.S. was specifically carried out to pave the way for the rigged purchase.

One of the issues that have delayed a conclusion prior to today centers around legal charges to be brought against Attorney-General Chaikasem Nitisiri, who was the former member of Airports of Thailand’s Board of Directors and is implicated in the case.

According to sub-committee chairman Amnuay Thantara, former Prime Minister Thaksin Shinawatra and Transport Minister Suriya Jungrungreangkit would face the harshest charges.

Trouble with Sisaket Housing Project

Buyers of the Ua Arthorn Housing Project in Sisaket province are hoping to meet the Prime Minister today. They have arrived at Government House to appeal their case after being over charged for houses bought under the Thaksin administration’s so-called cheap housing developments.

Representatives of villagers from Sisaket province arrived at Government House this morning hoping to plead their case to Prime Minister Samak Sundaravej.

They claim that they have received bank invoices for their home loans which indicate an amount that is much higher than the price earlier quoted by the National Housing Authority.

As many as 280 households are experiencing the same problem.

Some home owners have received eviction notices if they do not pay the required amount by tomorrow.

Representatives of the group claim that previous inquiries made to the National Housing Authority have not been answered. That is why they have come to Bangkok to plead their case to the Prime Minister and the media in hopes of getting help in the matter.

ASC to take legal action in CTX scanners case

The Assets Scrutiny Committee will take legal action against politicians, government officials and private sector operators for alleged bribery in the procurement of luggage scanners for Suvarnabhumi airport. It will identify the accused next Monday, ASC spokesman Sak Korsaengruang said. The panel had concluded its investigation into the matter and found three groups of offenders, holders of political positions, government officials who were committee members, and members of the private sector at the time, he said. The conclusion was based on evidence in Thailand and from the US, the country that supplied the 26 CTX scanners, which cost about four Billion Baht. An ASC sub-committee will prepare the legal cases and should conclude its work next

The lightning transfer of Virachai Plasai, Chief of the Treaties and Legal Affairs Department, is related to his role in the CTX bomb scanners investigation sources at the ministry said. Mr Virachai was said to have refused a demand by certain politicians who wanted to see classified documents in the CTX case, unless they provided a written request since the documents would be used in court. As Head of the Treaties and Legal Affairs Department, he supervised the translation for some CTX documents at the request of the Assets Scrutiny Committee (ASC). The ASC is to conclude the case, which implicated former PM Thaksin, former Transport Minister Suriya Jungrungreangkit and 20 other officials in alleged graft, on Monday. The sources said the reaction of Mr Virachai to the politicians' demands was in line with state regulations on the handling of classified documents, which requires transparency. The transfer of Mr Virachai to an inactive post took immediate effect. The abrupt transfer contradicted a statement by Foreign Minister Noppadon Pattama who had dismissed speculation that he would carry out a mid-term reshuffle at the ministry. Noppadon was unavailable for comment yesterday.

Transfer has nothing to do with CTX scandals : Noppadon

Foreign Minister Noppadon Pattama insisted on Friday that the surprise reshuffle that saw senior legal expert Virachai Plasai, Director-General for Treaties and Legal Affairs, be transferred to an inactive post was the right decision and has nothing to do with the CTX scandals.

"The reshuffle was made for appropriation. I would take responsibility for the decision," he said on Friday.

Krit Kraichitti from the Economic Affairs Department who replaced Virachai was the right person since he was a former director of the legal affairs department, the minister said.

The cabinet has already endorsed the reshuffled Tuesday.

A ministry source said Virachai was transferred to an inactive post since he refused to give to Noppadon a copy of documents concerning the purchasing contract of the CTX explosive detection which Foreign Ministry translated for Assets Examination Committee.

AEC has been investigating a corruption charge against ex-prime minister Thaksin Shinawatra and his associates over the purchase to the CTX bomb detectors.

Noppadon was a former spokesman and personal lawyer of Thaksin. :o

The AEC would make the final decision on Monday whether to indict Thaksin and his associates over the corruption case. However, Noppadon said the motivation behind his decision was the Ministry's internal affairs.

"I don't want to disclose inside information which could damage our ministry's reputation, but I can guarantee the reshuffle has nothing to do with the CTX case," he said. *and your word carries about as much weight as one-third of a single grain of rice. Your subordinate didn't want to improperly "disclose inside information" and you fired him for it.*

Earlier, Permanent Secretary Virasak Futrakul issued an open letter to the officials of the Legal Affairs Department to give moral support to Virachai who he said has worked with honesty and integrity.

ASC may file Thaksin graft charge Monday

Ex-premier, associates targets of CTX inquiry

The Assets Scrutiny Committee is likely to conclude on Monday whether to file an indictment against deposed PM Thaksin Shinawatra and his close associates for alleged corruption in the CTX 9000 bomb scanners purchase case. A sub-panel has recommended the ASC take legal action against 23 suspects, including Thaksin, other prominent politicians, and senior officials, based on 21 legal issues. The ASC has finished considering 16 of them. The other five are expected to be concluded on Monday. The conclusion was based on evidence in Thailand and from the USA, the country that supplied the 26 CTX scanners, which cost about four billion baht. Others well-known figures named as suspects include former Transport Minister Suriya Jungrungreangkit; New Bangkok International Airport Co (NBIA) Board Chairman Srisuk Chandrangsu; former Airports of Thailand (AoT) Board Chairman [and current Deputy Prime Minister and Education Minister and Thaksin's brother-in-law] Somchai Wongsawat; former NBIA Board members ACM Kongsak Wantana, Attorney-General Chaikasem Nitisiri, and owner of the CTX local distribution firm Worapoj Yasadatt.

Principles and integrity are qualities which are anathema to this govt. and will be rooted out and thrown aside at all costs, so it appears from the sheer amount of transfers to The Inactive Posts Dept. At least the DG of the IPD should be busy these days, overseeing all his hive of inactivity. Old Crutch should be working overtime mind you, thinking up new plots for his favourite bunch of bureaucrats. :o

AEC close to wrapping up report into airport bomb scanner case

The Assets Examination Committee will today deliberate the report on the probe into suspected corruption in the purchase of CTX bomb scanners for Suvarnabhumi international airport.

AEC member Udom Fuangfoong said yesterday the panel was expected to wrap up the CTX case and send it to the Attorney-General's Office for prosecution at the Supreme Court's Criminal Division for Holders of Political Positions.

The AEC earlier assigned its CTX investigative committee to revise its report to add the charges of collusion in bidding on government projects, he said.

The extra charges were needed because the US Justice Department had concluded that the CTX supplier paid bribes to Thai authorities to win the contract, he said.

The documents from the US Justice Department will be used as evidence in the case, he said.

If the AEC can finish reviewing the CTX file in the morning, in the afternoon it will take up the case of alleged abuse of authority by former prime minister Thaksin Shinawatra in having the Export-Import Bank of Thailand open a credit line for Burma.

The AEC may consider setting up a joint committee with the Attorney-General's Office to work on the Exim Bank case after state prosecutors declined to indict Thaksin.

They had wanted the AEC to first interrogate Surakiart Sathirathai, who was Foreign Minister at the time, he added.

Noppadon called to explain

Senate's Committee of Foreign Affairs would seek Foreign Minister Noppadon Pattama's testimony over a reshuffle at the ministry involving Virachai Plasai being removed from his post.

The issue would be in the committee's agenda next week and Noppadon would be invited to the testimony otherwise the committee would visit him at the ministry to ask for an explanation, said Senate Committee Chairman Pikulkaew Kraireuk.

Political factors could be the reason behind the reshuffle to remove Virachai as Director of the Treaties and Legal Affairs Department since he is highly qualified for the job, he said.

Noppadon denied last week that Virachai was transferred because he had refused to give him a copy of documents concerning the purchase of CTX bomb detectors. The CTX case is the subject of a corruption probe by the Assets Examination Committee involving former prime minister Thaksin Shinawatra and some of his associates.

Auditor-General Khunying Jaruvan Maintaka yesterday sent her representatives with flowers to the Foreign Ministry to give moral support to Virachai, who was abroad. Jaruvan said she would visit Virachai when he returned, according to one of her representatives.

Noppadon said he had no problem with Jaruvan's gesture, saying that giving flowers to each other was good manners.

CTX pressure grows at Foreign Ministry

Many officials at the Foreign Ministry are seeking a transfer to avoid political pressure from politicians trying to access confidential information on the procurement of the scandal-tainted CTX luggage scanners. Pikulkaeo Krairirk, Chairwoman of the Senate Foreign Affairs Committee, said a complaint has been received from a senior official of the Foreign Ministry's Secretariat. The official decided to seek a transfer after receiving an ''unfair order'' from above that he find and hand over all the documents on the Suvarnabhumi airport luggage scanners that could weaken the case against members of the former Thaksin Shinawatra government. The Foreign Ministry had earlier been informed by the US Department of Justice about price manipulation in the deal. It concerns bribery related to the multi-billion-baht import of the 26 computer tomography X-ray (CTX) machines. Withdrawal of the information requires a signature and the senior official who has access to the information has been pressured by some powerful politicians to sign the request, she said. It was reported that even the Foreign Minister had no direct access to the information. Pikulkaeo said she would bring the matter to the attention of her Senate Committee and invite Foreign Minister Noppadon Pattama to clarify the allegation. Noppadon used to be a lawyer working for Thaksin. Pikulkaeo said she would also ask Noppadon whether any politicians were unhappy with the former Director-General of the Treaties and Legal Affairs Department because he protected the confidential information. The papers could possibly be used by investigators to nail those who had personally gained from the scanner procurement. The Director-General of the Treaties and Legal Affairs Department, Virachai Plasai, was suddenly replaced last week by the Foreign Minister. Ms Pikulkaeo said many other government officials at the Foreign Ministry were under similar pressure and had sought transfers. She had received anonymous complaints from many others. Toxin and his handpicked minions in the Cabinet are really proving all over again that they are the supreme dividers of Thai society at all levels, from the rural village up to the most important Ministries of the land. It's rather a pity though that when otherwise honest Thai bureaucrats come across malfeasance or downright mega-corruption in office, they handle it in a roundabout way such as this transfer request game, rather than just blowing the whistle as to what's actually going on. It might save a lot of time and later heartache if people could be a little bit more open, but it's not going to happen any time soon I'm sure. Chinese whispers can't hold a candle to the Thai nods, winks and wais of political intrigue going on in high places at the moment. "To coup or not to coup?" that must be a question on many people's minds in Krungers these days.........................

AEC: CTX is 1.7 Billion Baht overpriced

The Assets Examination Committee on Wednesday decided to seek Attorney-General's decision to indict politicians and airport officials for causing the state 1.7 Billion Baht in damage in having to buy a highly-inflated price of CTX bomb detection machine for the Suvarnabhumi Airport.

AEC spokesman Sak Korsaengruang said the AEC also decided that all the suspects who entered into the agreements with GE InVision, and allegedly violating Article 149 of the Criminal law, return 6.936 Billion Baht to the state.

AEC Submits CTX Bomb Scanner Probe to Court

The assets probe panel will file the case of the CTX bomb scanner purchase to the Attorney-General for further submission to the Supreme Court. Ousted Prime Minister Thaksin Shinawatra has allegedly been found to be involved in the scandal.

The Assets Examination Committee or AEC has unanimously resolved to file the CTX 9000 bomb detector scandal for the Suvarnabhumi airport to the Atorney-General, for further submission to the Supreme Court's Division for Political Office Holders.

AEC Spokesman Sak Korsaengruang said the defendants of the case are categorized into three groups.

The first group is politicians, including exiled Prime Minister Thaksin Shinawatra, former Transport Minister Suriya Jungrungreangkit, and current Deputy Prime Minister and Education Minister Somchai Wongsawat.

The second group includes officers of the New Bangkok International Airport Company, including the Attorney-General Chaikasem Nitisiri, who is a former board member of the firm.

Sak revealed that the panel will pass the prosecution to Attorney-General Chaikasem, giving the reason that the plaintiff has an interest in the case. *I imagine he would...especially as one of the defendants.* :o:D

The last group includes individuals who are accused in the bomb scanner purchase, including Managing Director of Patriot Business Consultant Company Worapoj Yasadatt, who was the broker of the deal.

In accordance with the investigation, the AEC Spokesman said the defendants set up specifications for the bomb detectors for Suvarnabhumi Airport, avoided fair competition, and provided support to only certain companies, and called for illegal benefits for contract partners on the project.

The accused are charged with violating the Act Concerning Offences Relating to the Submission of Bids to Government Agencies and the Act on Offence of State Organization or State Agency Official.

The panel also proposed a penalty for the plaintiffs to repay the procurement price difference of 6.936 Billion Baht, and asked the Attorney-General to submit the investigation report to the Supreme Court within seven days.

Today's Assets Examination Committee meeting decides that there is merit to the charge against the ousted premier for cronyism and forwards the case to the Attorney-General for the confiscation of his assets worth 77 billion baht.

The Assets Examination Committee concluded today that there is reason to believe ousted premier Thaksin Shinawatra abused his power to benefit his family business and that of his cronies.

The AEC will forward the case to the Attorney-General's Office to be filed with the courts.

It will also ask the court to approve the confiscation of the cash from the sale of Thaksin's family business, Shin Corporation, to Singapore's Temasek Holdings, worth 77 billion baht.

If the Attorney-General's Office disagrees with the AEC and does not file the case, the AEC can go ahead and file it with the court independently.

I don't think so, they will never move one inch (no matter what they are doing), until either/or: election loose or coup. All court cases will be purged and/or bought, no?

Question: Once convicted (if), they all seam to get bail anyhow, right? No matter what they did? So any rich man can stay in power (speak out of prison) forever, if he knows how to win the elections (no matter what they start doing one day after election)!??

Thaksin's defence lawyer denies involving police to harass graft busters

Lawyer Pichit Chuenban on Friday dismissed the speculation that he was invoking the legal proceedings by police to intimidate graft busters in charge of investigating his client and former prime minister Thaksin Shinawatra.

Pichit conceded, however, that he wanted the graft busters to experience the same ordeal of being suspected wrongdoers as what Thaksin had gone through.

In recent days, police have summoned 11 members of the Assets Examination Committee for questioning and issued an arrest warrant against a senior justice official Sunai Manomai-udom.

Pichit said he was responsible for a defamation complaint against Sunai.

He was also behind the complaint on the AEC mandate. In both cases, police were oblige to enforce the criminal procedures as charges were filed against Sunai and AEC members as individuals and not their office, he said.

Ong-art accuses government of using intimidation

The Democrat Party yesterday accused the PPP-led government of brow-beating civil servants involved in the legal processes against former PM Thaksin and other members of his Cabinet. Opposition spokesman Ong-art Klampaiboon said such attempts to intervene in corruption cases against Thaksin and his associates are dangerous. Mr Ong-art said the Democrats have found that several civil servants taking part in legal processes on corruption charges against members of the Thaksin administrations have been unfairly treated and intimidated by the government. Also among the civil servants believed to have been victimised in the government's retaliation is Sunai Manomai-udom, a former Director-General of the Department of Special Investigation (DSI). Mr Ong-art said after Mr Sunai told the press that the DSI had witnesses to support its legal action against Thaksin, the former PM assigned his lawyer to file a libel complaint against him at Wang Noi police station in Ayutthaya. Despite the fact that libelling someone was a minor offence, police sought an arrest warrant for Mr Sunai from the Criminal Court and tried to arrest him at Suvarnabhumi Airport on Wednesday. The Democrats believe the attempted arrest was excessive and inappropriate, said Mr Ong-art. He said police are also reportedly seeking arrest warrants for members of the Assets Scrutiny Committee (ASC) who are facing defamation charges filed by Thaksin. ''The police are overdoing it again,'' said Mr Ong-art. Officials at the Revenue Department are also under pressure to find ways to unfreeze the assets of the Shinawatra family, according to Mr Ong-art. Legal Execution Department Chief Kanyanuch Sorthip's recent abrupt transfer was a bid to make an example of a senior officer who has been assisting the ASC's sub-panel investigating Potjaman Shinawatra's 772-million-baht land purchase in the Ratchadapisek area of Bangkok, claimed Mr Ong-art.

Thaksin's plan to avoid the court cases:

1.Change the constitution to render legal proceedings void.

2.Transfer, intimidate or threaten any official invloved in the judicial process seen as unfriendly to Thaksin.

The problem for Thaksin is the Democrats and PAD have seen through his game for a long time now.

Just face the courts like a real man please.

Just face the courts like a real man please.

I think this is a reasonable position.But it's only reasonable to sideline any official in the judicial process that is friendly or unfriendly to Thaksin.Justice should be blind.In an ideal world there would be a parallel process where the junta would also be put on trial for their treachery.Oh no I forgot they have given themselves an amnesty and enshrined it in their rigged constitution.

The possibility of this happening to a foreign businessman should be in the mind of anyone considering investing in Thailand .
