rooster59 Posted July 1, 2017 Share Posted July 1, 2017 Exat wins “expressway stupid fee” case against CH Karnchang After 16 years of marathon court battle, the Expressway Authority of Thailand won the court case against construction giant CH Karnchang Pol over the construction of the 55-km Bang Na-Chon Buri expressway. The Supreme Court has ruled in favour of the state agency by upholding the Appeals Court’s decision that Exat, formerly Expressway and Rapid Transit Authority (ETA), needs not have to pay the CH Karnchang-led joint venture the 9.6 billion baht in compensation as ruled by the arbitration committee for the delay in the handover of construction areas to the expressway builders. The joint venture includes German engineering groups Bilfinger Berger Bauaktiengesellshaft and Dyckerhof & Widmann AG. Thais have preferential treatment over many things, not everybody is the same in front of the law. If bigger/richer/more influential Thais can steamroller their own underlings (see all those ridiculous pending cases like the Red Bull grand kid) - then what do you think happens, if the opposite is an "alien"? Over time this will correct itself, if they like it or not - the last big lesson was when Germany explained then Foreign Minister Kasit Piromya, that not even the government (in Germany that is) is above the law. At least Kingsgate have the Thai-Australia FTA to batter the government with. And didn't Carlsberg beat Chang at an international arbitration for their spectacular (but entirely predictable) business fallout a while back?
