In its decision, the court found Jatuporn guilty for a 2009 speech delivered to an audience of thousands in Bangkok in which he accused former Prime Minister Abhisit Vejjajiva of ordering soldiers to kill Redshirt supporters earlier that year at a protest in Bangkok’s Din Daeng district. webfact Posted July 20, 2017 Author Share Posted July 20, 2017 Jatuporn gets one year jail for defaming Abhisit By The Nation BANGKOK: -- Jatuporn Prompan, chairman of the red-shirt group, has been handed a one-year jail term for defaming former prime minister Abhisit Vejjajiva in speeches he made in 2009. The Supreme Court on Thursday sentenced Jatuporn to one year in prison without suspension and ordered him to publish apologies to Abhisit in newspapers for seven days. Abhisit had filed a case in June 2009, accusing Jatuporn, a leader of the United Front for Democracy Against Dictatorship (UDD), of defaming him in front of 10,000 people through loud speakers at Wat Phai Kiew Temple in Don Muang in Bangkok on May 10. Jatuporn had called Abhisit a “tyrant” whose “hands are tainted with blood” who deserved to be sentenced to death for killing people. The Court of First Instance had rejected the case on December 27, 2012, saying that to comment was tantamount to political retaliation in a democratic system. Abhisit took his case to the Appeal Court, which upheld the first court’s ruling and rejected his plea saying comments by Jatuporn were honestly made. Siripon Posted July 20, 2017 Share Posted July 20, 2017 He should be in jail for his remarks and behaviour at Ratchaprasong during the red shirt occupation, as Suthep should be for his occupation more recently. Jatupon himself said under the present rulers, the red shirt leaders would all find themselves in jail or would wind up dead. Perhaps there is a strategy to weaken Pheua Thai before the election. Jatuporn Prompan, chairman of the United Front for Democracy Against Dictatorship, has been handed a one-year jail term for defaming former Prime Minister Abhisit Vejjajiva over speeches he had made in 2009. Kobkiat said if Jutaporn was sick, the department would ensure he gets medical care, but would not take him to an outside hospital. Jatuporn was ill while under detention in Bangkok Remand Prison related to another case, and received medical treatment until he got well. When moved, Jatuporn should inform prison officials about his health condition so that he can get proper treatment, Kobkiat suggested. Maybe he gets some time of for good behavior but at least he will be in time for a while. That will teach him not to lie. I don't like the defamation laws here, but in this case I make an exception. Any court action that enables a civil action to result in imprisonment is clumsy, heavy-handed and leaves the court system open to accusations of political interference. Jatuporn Prompan is a key leader of the "red shirt" supporters of former Prime Minister Thaksin Shinawatra and his sister, Yingluck Shinawatra, who also served as prime minister. Their governments were both ousted in military coups, in 2006 and 2014 respectively. Jatuporn led street protests in 2010 when the supporters of the populist former telecommunications tycoon Thaksin occupied a Bangkok shopping district for nearly two months, calling for the then prime minister, Abhisit Vejjajiva, to resign. The Supreme Court found Jatuporn guilty of calling Abhisit a murderer in a speech during the protests, which ended in bloody confrontation between the military and demonstrators in which more than 90 people were killed, most of them civilians. Jatuporn's speech had not been fact-checked and had been made for political gain, causing damage to Abhisit's reputation, the court said. Jatuporn did not speak to the court or to reporters, but only smiled as he was led away to jail, media reported. Confrontation between the Shinawatras and their legions of supporters, especially among the rural poor, on the one hand, and the military-dominated establishment, based in Bangkok, on the other, has divided Thailand for more than a decade. Jatuporn won a seat in parliament in a 2011 general election, when Yingluck led the Shinawatras' party to victory. Thaksin has lived in self-exile since 2008 to avoid a corruption conviction he says was politically motivated. Yingluck was ousted as prime minister days before a 2014 coup and she too faces trial in connection with accusations she mismanaged an extravagant rice-subsidy programme. The military government that has ruled since the 2014 coup has moved to suppress dissent and detained critics, many of them supporters of the Shinawatras. Jatuporn was already on bail for another defamation case brought forward by Abhisit and a terrorism charge in 2010.
