  1. Note that Mr. Penny's own lawyers set up a GiveFundGo account -- which unlike GoFundMe allows for funds raised for violent criminal charges defense -- that raised USD $3,368,223. Funds are likely now being set up for Mr. Mangione regarding the Thompson murder. No comment yet from his retained NY criminal attorneys as to how they are or will be compensated.
  2. REDUX Posted November 3 From the complaint filed in Amarillo TX Federal Court: 55. President Trump is a “consumer” within the meaning of the DTPA, since he is an individual who sought and received CBS’s broadcast services. From the DPTA Texas statutes: Sec. 17.45. DEFINITIONS. As used in this subchapter: (4) "Consumer" means an individual, partnership, corporation, this state, or a subdivision or agency of this state who seeks or acquires by purchase or lease, any goods or services, except that the term does not include a business consumer that has assets of $25 million or more, or that is owned or controlled by a corporation or entity with assets of $25 million or more. https://statutes.capitol.texas.gov/Docs/BC/htm/BC.17.htm
  3. But that case -- Trump Sues CBS for $10 Billion Over Alleged Editing in Kamala Harris Interview -- isn't maybe going so well.
  4. After her book excerpt was first published but before her retaining a high-power attorney Ms. Carroll said this in a 20019 interview: (But) when asked if she would pursue charges against Trump for his alleged behavior, Carroll said “No.” “I would find it disrespectful to the women who are down on the border who are being raped around the clock down there without any protection,” Carroll said. “The women have very little protection there. It would just be disrespectful.” The New York Times recently reported that migrant women and girls along the U.S. Mexico border are sexually assaulted in incidents that are unreported or prosecuted. Carroll continued, “Mine was three minutes. I’m a mature woman. I can handle it. I can keep going. You know my life has gone on. I’m a happy woman. But for the women down there and, actually, around the world, you know, in every culture this is going on no matter high in society or low in society, it just seems disrespectful that I would bring — it just doesn’t make sense to me.” https://www.hollywoodreporter.com/lifestyle/lifestyle-news/writer-e-jean-carroll-no-disrespectful-rape-charges-trump-1220447/ NB In NY State there is no statute of limitations for criminal rape first degree.
  5. Not only could Ms. Carroll not remember the date, but her 2 contemporaneous phone call witnesses -- both professional journalists -- could not remember the date either.
  6. UnitedHealthcare CEO killing latest: Investigators spoke to Mangione's mother before arrest Mangione’s mother had filed a missing persons report about her son on Nov. 18. December 15, 2024, 2:05 AM A task force comprised of FBI agents and NYPD detectives spoke to Luigi Mangione’s mother one day before he was arrested in Pennsylvania and named a suspect in the shooting death of UnitedHealthcare CEO Brian Thompson, law enforcement sources told ABC News. The conversation followed a tip the FBI received from police in San Francisco, where Mangione’s mother had filed a missing persons report about her son on Nov. 18. The tip from SFPD was based on physical appearance and Mangione’s mother, in her conversation with the Joint Violent Crimes Task Force last Sunday, indicated the person in the surveillance photos circulated by the NYPD could be her son, the sources said. https://abcnews.go.com/US/unitedhealthcare-ceo-killing-latest-mangiones-veteran-new-york/story?id=116787673
  7. My explanation of what Judge Kaplan said: If a woman says to you out of the blue, 'I was raped', that in and of itself does not imply penal insertion but 'rape' as in violated can reference other types of sexual assault. However Ms, Carroll herself, post-trial, that there was penal insertion just that it was her fault she was not able to convince that that was the nature of the 'rape'.
  8. Yes, it was pointed out on here by me and others that the jury verdict sheet said 'NO' as to whether Trump was culpable for first degree rape and the jury only said 'YES' to assault.
  9. Supporters of suspected CEO killer Luigi Mangione establish defense fund Mangione's (Pennsylvania) attorney said he might not accept the money that has been raised. December 14, 2024, 8:30 PM EST -- As New York City prosecutors work to bring murder charges against Luigi Mangione in the brazen killing of UnitedHealthcare CEO Brian Thompson, supporters of the suspect are donating tens of thousands of dollars for a defense fund established for him, leaving law enforcement officials worried Mangione is being turned into a martyr. Several online defense funds have been created for Mangione by anonymous people, including one on the crowdfunding website GiveSendGo that as of Saturday morning had raised over $93,000. <SKIP> Most recently, Marine veteran Daniel Penny was acquitted of criminally negligent homicide in the chokehold death of Jordan Neely, a homeless man who was acting erratically on a New York City subway, after supporters donated more than $3 million to his legal defense fund. https://abcnews.go.com/US/supporters-suspected-ceo-killer-luigi-mangione-establish-defense/story?id=116718574
  10. UPDATE on charges: When Mangione is extradited back to New York, the NYPD plans to charge him with premeditated first-degree murder, a charge usually reserved for the murder of an NYPD officer, but the district attorney's office has the final discretion on charges.
  11. He has been charged in Pennsylvania with carrying a gun without a license, forgery, falsely identifying himself to authorities and possessing "instruments of crime," according to a criminal complaint. I read that some former law guy said that the fact that Mangione still had possession of the gun (for which there was an underwater search in NY Central Park) is that he was intending to use it in further crimes which could possibly lead to terrorism-type charges.
  12. The whole pardon thing in this topoi c is because someone (humorously?) suggested that Biden could pardon Mangione.
  13. First-degree murder Involves special circumstances, such as: Murder of a police officer, judge, fireman, or witness to a crime Multiple murders Torture or especially heinous murders Murder for hire The death occurring in the process of committing another felony Second-degree murder Any other premeditated murder, or a felony murder that does not involve special circumstances So 1st and 2nd degree murders are both pre-meditated.
  14. In NY State 'premeditation' does not figure in the difference between 1st and 2nd degree murder.
  15. Luigi Mangione retains high-powered New York attorney as he faces second-degree murder charge Updated 9:59 PM EST, Fri December 13, 2024 Karen Friedman Agnifilo will represent him in New York. Friedman Agnifilo previously worked as the chief assistant district attorney in the Manhattan District Attorney’s Office under Cyrus Vance Jr. for seven years and is a veteran with deep experience in New York City’s criminal justice system. She has worked in private practice since 2021. “She’s got as much experience as any human being, especially in the state court,” one longtime New York prosecutor told CNN. “She knows every corridor, every judge, every clerk in the courthouse.” <SKIP> A representative for Friedman Agnifilo declined to comment on who is paying his legal fees. https://edition.cnn.com/2024/12/13/us/luigi-mangione-new-york-attorney-retained/index.html
  16. McKinsey is a privately held corporation. Its only shareholders are partners.
  17. Constitutional Amendment: In the 1886 case Ex parte Garland, the (US Supreme) Court referred to the President’s authority to pardon as unlimited except in cases of impeachment, extending to every offence known to the law and able to be exercised either before legal proceedings are taken, or during their pendency, or after conviction and judgment. https://constitution.congress.gov/browse/essay/artII-S2-C1-3-1/ALDE_00013316/
  18. There is a constitutional right to US Presidential pardons and -- once effected -- there is no mechanism for a challenge.
  19. He has not been charged with a federal crime and -- if Biden wants to pardon him -- he would have to be so charged before Biden leaves office Jan 20, 2025
  20. Mangione has not been charged with a federal crime.
  21. From Lakeland, FL Polk County which went 60% for Trump 2024.
  22. Re: "people can only be pushed so far" there is no record that Mr. Mangione was a UnitedHealthcare policy holder individually or through employment or that he had any financial problems regarding his back surgery whether covered by insurance or not. The only record seems to be his mention online that he was treated for irritable bowel syndrome by BlueCross/BlueShield. So, this does not seem to be a case that someone was 'pushed' by a personal experience with a healthcare insurer denying coverage.
  23. Not yet: 12 DEC 2024 -- FBI Director Christopher Wray told employees at an internal town hall on Wednesday that he is resigning, according to sources familiar with the meeting. He said he is stepping down at the end of the current Biden administration. (my bold) "After weeks of careful thought, I've decided the right thing for the Bureau is for me to serve until the end of the current administration in January and then step down. https://abcnews.go.com/Politics/fbi-director-chris-wray-resigning-amid-pressure-trump/story?id=116653050
  24. I'll add these: Anatomy of a Murder (1959) Bullitt (1968) The Verdict (1982 -- David Mamet screenplay)
