State prosecutor says former premier may have applied for political asylum

 

FORMER prime minister Yingluck Shinawatra may have been given a provisional visa by the UK based on humanitarian grounds while her application for political asylum is considered. 

 

The UK law allows applicants to stay in the country for up to five years for those who are qualified and are approved by the UK’s Interior Ministry, according to a senior Thai public prosecutor.

 

Responding to the recent sighting in public of Yingluck along with an unidentified Thai woman in London, Thanakit Worathanachakul, a senior prosecutor at the Office of the Attorney-General, said the former premier could also seek a further five-year extension to stay in the UK after completing the first five years.

 

Yingluck fled the country last year just before the Supreme Court was due to read its verdict in the case against her over her government’s rice-pledging scheme. The court sentenced her to five years in jail for neglecting her official duty while supervising the scheme, resulting in a massive financial losses to the state.

 

According to Thanakit, it is highly likely that Yingluck has already applied, or will soon apply, for political asylum in the UK. Citing the UK’s law, he said there must be substantial evidence and reasons to justify the application for asylum. For example, applicants may state that they are fearful of maltreatment, physical assaults and unfair prosecution if they return to their home country.

 

Applicants may also seek political asylum based on racial, religious, nationality or political grounds as soon as they arrive in the UK. Afterwards, they will be interviewed by UK officials, who will review documents and other evidence provided by the applicants and their lawyers.

 

Applicants also need to provide information on their place of residence in the UK, while their spouses and children under 18 may also apply for the same status subject to approval by the UK Interior Ministry.

 

If the applications are rejected, they can lodge an appeal with the UK court to review their request. Thanarit said applicants who get approval would be able to stay in the UK for five years after which they could seek an extension of another five years if they could prove they still faced persecution in their home country.

 

In the event that any applications are rejected by the court due to lack of qualifications, the applicants, their spouses and minor children may still stay in the UK on humanitarian grounds for a period of five years with a possible extension of another five years.

 

Meanwhile, national police chief General Chaktip Chaichinda insisted that the Thai police, in cooperation with Interpol, remained committed to getting Yingluck back to Thailand after a deputy national police chief confirmed that the photos showing Yingluck and another Thai woman in London were likely to be genuine.

 

Thai authorities said they believed Yingluck did not use her Thai passports to travel and enter the UK since the documents were already invalid.

Damn right she has! We still do not understand that most countries are refusing to extradite a person to a country without a democratically elected govenment. I am pretty sure that she´s going to get her political asylum too.  Move on, folks. Not much more to see here.

As far as I am aware, the U.K. does not have an Interior Ministry! All applications for political asylum are dealt with through the Home Office, or have things changed since I was last there!

For one thing Yingluck is not going to be extradited to be locked up for something that is not a crime in the UK.

 

For another, her conviction and sentence for the same must surely provide "substantial evidence and reasons to justify the application for asylum".

 

The Thai powers that be harping on about seeking extradition, can only strengthen Yingluck's case to stay in the UK, and make themselves look like ineffectual bullies.

UK will grant asylum to anyone provided they have enough money and assets in the UK. No morals.

We have read a lot about applications being submitted to Interpol concerning two recent applications by the Thai police for assistance from them about bringing them back to Thailand.  So far, Interpol does not appear too concerned about either of them.  If the Thai authorities cannot prevent, resolve, or clean up cases within their own jurisdiction according to Thai laws, which it appears can be easily and readily circumvented if one has the status, position, knowledge, and money to do so, while the persons are still within the country, then why would any institution even offer to help.  Maybe, Interpol may have put things on hold while waiting for some reason unknown to us regarding their lack of involvement.  If the Thai authorities cannot arrest a cop killer while the killer is within the geographical boundaries of the country, why should Interpol waste its resources to help clean up the Thai authorities made mess?

I doubt Interpol even know anything about either of these cases 

Need to take the MAY get out of the title. She will and having a huge wealth I'm sure will play nothing into the decision making.  I would doubt anyone on this forum could name one non corrupt government. All have various degrees of it

There are many in the UK who are granted asylum without having a pot to p!ss in. She has ample grounds for asylum status without her money, not that having lots and lots of it will do her any harm options-wise. 

it's so very simple. UK justice doesn't believe its Thai counterpart. Why Thai journalists can't say so????

I don't worry about it, it was just a thought about the potential comeback.

I have applied for political asylum in Thailand. Get back to me and I'll let you know how its going.

She has loads of money, do you really think she has to go through the same process as normal people. I think its easier for YL to get in the UK then for you married Brits to get your partner in there to live with you. I guess that is all fair and so on.

Yes she does.  I remind you that the former PM was a successful business women long before she entered politics and already had assets in the UK. Here application will be reviewed under the same rules that apply to other applicants in her class (as in political asylum class). She will have an easier time because;

1. Her  history is documented, established and known. There will be no need to significantly vet the  claim of political discrimination as is the case of  the Pakistanis, Nigerians etc. However, she will still be subject to a detailed  indepth investigation of claim.

2. Her ability to support herself, and her education are already established and this  will facilitate an application for longer term residence.

3. She will have multiple letters of support from international organizations and UK responsible parties  which will support her claim.

 

In simple language, she  has all the boxes checked for her application and is the text book candidate for political asylum.

Malicious lie. The rules were established  decades ago and updated  by sitting parliaments, including Labour, Conservative and Coalition.  The Tory way has no sway in the interpretation of the rules which will be done by a  member of the left leaning public service union. The "Tories" cannot intervene, anymore than Labour could. All they can do is change the rules under which asylum requests are  processed and that takes years to do.

Another malicious falsehood. Why do you lie? What part of the  Refugee Regulations do you not understand? Are you aware that the current rules  for refugee status do not focus on money and assets but are fact based? Wealthy emigres  typically do not make political asylum claims.  Your comment is  so ignorant as to be offensive. Are you even aware that a political refugee claimant opens him/herself up to an in depth review of activity and history greater than that of a normal  immigrant? If you are angry and  embittered about your poor financial state and low social status, look in the mirror and deal with it. Don't make a false statement intended to hurt legitimate political refugees.

She has a lotta money,so she will get preferential treatment in UK,

just like all those Oligarchs,but you try to take your wife, G/f there, 

barriers are raised.
