Divorce before visa application

Hello,

Looking for some advice for a friend.

No really it is a friend. I’m happily married and we have a cracking 6 month together.

 

My mate married his Thai lady in The Pattaya amphoe/ registrar office.

This happened last February and he has been in uk and she’s been in Thailand ever since. She was due to apply for the settlement visa soon but they have had a big fall out.

She now wants a divorce and is demanding 500k baht.

 

What’s his next step? Can she claim anything and what’s the easiest way for him to divorce?

Under Thai law she only has a claim to 50% of all the assets gained during the marriage. Assets as in gains and loses incurred, for both of them.

 

Her not cooperating means that it is more difficult to get a divorce as one can then only divorce based on the reasons stated in the law.

Agreed but not an offer. Make it a set amount and don't negotiate at all. And fan all the bills out when you show it to her. Thais love that.

Why would he marry her if he wasn't going to stay by her side?

Thai women don't want to be "played".

They get enough of that in their "business" activities.

Your friend should resolve the issue in a way that is fair for both sides.

From there .... life goes on.

His best way to divorce is to hop on a plane with a stopover in the middle east, and, when there, recite the divorce call three times

Then continue on to England, get a job, save, and when wiser and richer, contemplate a move to a culturally diverse country.

But only for assets in Thailand what been earned and bought after the mariage.

Do nothing,

 

Send registered letter to her every 3 month in asking her to come and take care.

Wait 3 years and file the divorce in thai court based on not taken care by her. 

If she not decided to go to the amphur with you and registered the divorces

 

she locked herself up with the marriage.

And the guy who she is with the friend can also claim compensation for financial losses your friend has due to his involvement with a married woman who wants to divorce.

Section about this you can find back in the thai law for th a bt hidden so foreigner can not find easy

The most convenient way is to get a divorce in "mutual agreement", just go the the Amphur and pay the fee.

Another possible way is (as mentioned by another TV-member) doing nothing, leave it as it is...but don't buy property or assets because still being married she could claim 50/50 whenever it comes to divorce.  Of course neither of you can marry another person.

The most complicated way is getting a divorce by appealing a lawyer's interaction; many shark-lawyers will demand a high fee and often "collaborate" with the wife (even those who were advertising on TV)...  There are exceptions...
