Trump won Stormy Daniels legal case in arbitration: White House

WASHINGTON (Reuters) - President Donald Trump has already won a legal case against adult-film actress Stormy Daniels in arbitration, his spokeswoman said on Wednesday, a day after Daniels sued seeking to invalidate a "hush agreement" she signed with Trump's lawyer.

 

Daniels, whose legal name is Stephanie Clifford, said in the lawsuit that Trump never signed the nondisclosure agreement, designed to keep her quiet about an "intimate relationship" she said she had with him over a decade ago.

 

Trump's failure to sign renders the pact invalid, the lawsuit said.

 

Clifford has said she was taking legal action to be able to speak freely about the "intimate relationship" without fear of retribution.

 

According to the lawsuit, Clifford and Trump had an intimate relationship that began in the summer of 2006, not long after Trump's wife Melania gave birth to their son Barron, and lasted well into 2007.

 

Reuters could not independently confirm any of the allegations.

 

White House spokeswoman Sarah Huckabee Sanders denied Trump had an affair with Clifford and said arbitration over the legal case with the actress was won by the president's personal attorneys.

 

"The president has addressed these (allegations by Clifford) directly and made very well clear that none of these allegations are true," Sanders said at Wednesday's White House press briefing.

 

"This case has already been won in arbitration and anything beyond that, I would refer you to the president's outside counsel."

 

A lawyer for the actress, Michael Avenatti, did not respond to a request for comment on Wednesday.

 

Clifford's lawsuit said Trump lawyer Michael Cohen initiated a "bogus arbitration proceeding" against her on Feb. 27, without notifying her, as part of efforts to "shut her up" and "protect Mr. Trump."

 

Cohen's lawyer Lawrence Rosen said in a statement on Wednesday that Cohen obtained an order from an arbitrator prohibiting Clifford from disclosing confidential information related to the nondisclosure agreement.

 

Cohen has previously acknowledged he paid Clifford $130,000 in October out of his own pocket to not discuss her claims of an affair with Trump.

 

Asked about the payment by Cohen to Clifford, Huckabee Sanders said she was not aware Trump knew of it at the time.

 

Cohen did not immediately respond to a request for comment. Trump attorneys John Dowd and Jay Sekulow were not immediately available for comment.

Trump and his  lawyers openly discussed what they believe is their side of the story.

 

SD is now going to court to argue that since Trump and his lawyers broke the agreement then the agreement has been invalidated and she can now speak on the matter and/or sell her story.

 

Seems fair to me.

Actually, it came from Trump's lawyer. There were reports that the lawyer was complaining that Trump hadn't reimbursed him for the expenditure. Now that the expenditure has been revealed, the lawyer says he gave it on his own, unprompted by Trump. Sounds believable.

Again, Trump is between zebra poop and alligator vomit.  And again, there is absolutely nothing too low for Trump to do - nothing will alienate his hard core fan base.

 

Gary Hart was running for prez in 1988.  He was leading the field among Dems - heading to the convention.  He was a fine man; intelligent, well-versed, capable, .....all the qualities Americans should look for in a president. .....yet he dropped out.   Why?  Because of one still photo showing an attractive woman sitting on his lap, outside on a boat.   

How times have changed!    Even what Bill Clinton did for 3 minutes with Monica Lewinski looks quaint from today's perspective - where Trump gets Putin to pre-approve his Cabinet picks, and is in 29 other quagmires.

 

The only good thing about Trump staying in office, is it shows Americans the depravity of the Republican Party and Bible-Thumpers (who have no problem with a man grabbing pussies, and lying as easily looking out a window).

.....is simply not true.  I've been watching/listening to a bunch of commentaries from today's news shows, and not one lawyer backs up that assertion.  It was a mouth fart from Sarah Huckabee, nothing more.

Not several years ago.

More likely a ruling from the arbitration (retired) judge last year came after Daniels reacted with innuendos of undisclosed information when Cohen began revealing some of the information covered by the nondisclosure agreement.

As to "decided," the arbitrator only imposed a "temporary restraining order," ie., until a final decision was made. According to Daniel's attorney even this is faulty as there's no evidence that Trump has an agreement with Daniels (restraining order was applied by a shield entity, not by Trump) nor did Trump pay her for nondisclosure.

But should the nondisclosure agreement itself be deemed incomplete, ie., lacks appropriate signatures, Daniel's attorney argues in a lawsuit against Trump that it is then unenforceable.

Trump has won little if anything. Especially now if he has to respond to the lawsuit, ie., give testimony.

And Trump is "upset" with his press secretary for giving the story legs......how  could you win something that you were not a part of......

Yes, good point. Why would Trumpy's lawyer fork out to the woman such a large sum of money from, 'his own pocket', in the first place if the story isn't true?

Actually, Cohen took out a home equity loan of $130,000 to pay Daniels. Surely, he expected to be reimbursed, ie., from the Trump Organization that was notified of Cohen's payment.

The agreement was only signed by his lawyer and not by him, so it shouldn't be valid to start with.

And if not valid, another porn star Jessica Drake who was another party to the agreement would be free to tell her story.

During the 2016 presidential campaign, Drake accused the future president of grabbing her, kissing her and offering her $10,000 for sex at a July 2006 event in Lake Tahoe, the same one where Clifford said she met Trump.
