webfact
Trump lawyer Cohen says will take 5th in Stormy Daniels case FILE PHOTO - U.S. President Donald Trump's personal lawyer Michael Cohen leaves federal court in the Manhattan borough of New York City, New York, U.S., April 16, 2018. REUTERS/Lucas Jackson (Reuters) - President Donald Trump's lawyer Michael Cohen said on Wednesday he would assert his Fifth Amendment right against self-incrimination in connection with a lawsuit filed by adult-film star Stormy Daniels, who says she had an affair with Trump. In a filing in Los Angeles federal court, Cohen said he decided to invoke his constitutional right after the FBI raided his home, office and hotel room two weeks ago. The FBI search was partly a referral by the Office of Special Counsel, Robert Mueller, who is investigating alleged Russian interference in the 2016 presidential election and possible collusion with the Trump campaign. Russia denies meddling in the election and Trump has denied any collusion. Last month, Daniels sued Trump and Cohen to end a non-disclosure agreement related to a $130,000 payment she received from Cohen before the 2016 election to keep quiet about her alleged one-night stand with Trump a decade earlier. Cohen has asked for the Daniels' case to be put on hold for 90 days. At a hearing last week, U.S. District Judge James Otero said he needed more time to review the request for a stay, but he told Cohen's attorney "there's some gaping holes" in the request. Lawyers for Trump and Cohen have said Daniels’ civil lawsuit overlaps the criminal probe of Cohen’s business affairs, and that letting her case proceed could both impair Cohen’s constitutional right against self-incrimination and make it harder for Trump to defend himself. bristolboy
I haven't seen the question addressed of how this affects the prospects of success for Stormy Daniels. It seems to me that if Cohen refuses to testify, it's pretty much assured that she will prevail in court. But that's just an uneducated guess. It has been said that if he takes the Fifth she will be unable to depose him and therefore unable to gather information needed. I really don't understand her case. As far as I understand it, she took the $130,000, didn't keep quiet and wants to be released to give her story. What's she going to reveal at this point? Like everything it's about how she can turn this into a money making deal. Cohen's problem with the feds is a different matter altogether. 4

But that doesn't mean the case falls apart. It's his choice. And as for the rest of the case. Donald Trump said that Cohen wasn't representing him. Cohen says that he wasn't paid by Trump. So Trump was not his client. A lawyer who acts on behalf of someone who hasn't authorized him to do so is probably looking to be disbarred. And any agreement signed to on behalf of a 3rd pary who denies he was being represented is invalid. 1

Cohen and Trump have called her a liar. She's suing for defamation. Even that's not the whole story. This Stormy/Trump/Cohen imbroglio is mushrooming bigger than a Texas-sized shit-storm. Nothing but bad and hurt can come out of it for Cohen and Trump. Trump shielders in the WH are admitting: the Stormy storm is probably more dangerous for the prez than the Mueller investigation, ....and could cause Trump's resignation. My theory: the minute after Cohen declares he will go 'state's witness', .....Trump will draft his resignation letter. Well, someone else will draft it, because Trump can't even write a paragraph without showing what an imbecile he is. Trump can ask me. I'll write his resignation letter for $5 and a photo of Trump in handcuffs, being frog-marched out of the WH by federal marshals. I'm concerned that Pence will pardon Trump. When Ford pardoned Nixon (a despicable act, btw), the pardon letter used a time frame, rather than mention any crimes. Same will happen when Pence pardons Trump (and Trump Jr, Flynn, Manafort, Ivanka, Jared, Stone, Cohen and dozens of other law-breakers), .....it will specify a time-frame covering years. excerpt from Ford's yellow-bellied pardon letter for Nixon....... Now, THEREFORE, I, GERALD R. FORD, President of the United States, pursuant to the pardon power conferred upon me by Article II, Section 2, of the Constitution, have granted and by these presents do grant a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from January 20, 1969 through August 9, 1974. Note: that time period is from the day Nixon was sworn in, to the day he left office with his tail between his legs. Same will happen when Pence pardons Trump. Despicable, the whole Republican cabal - top to bottom.
Popular Post spidermike007
Cohen is as guilty as Tiny Don. Both are as dirty as they come. Both have more skeletons in their closets, than a highlander Papuan cannibal. Both are going down, in my opinion. Don picked the wrong job, in which to be a liar and a cheat. In private business, he probably could have continued to get away with his filthy business practices, for the rest of his life. Not as president. Get used to saying President Pence. Lock them both up! Lock them both up! Edited April 26, 2018 by spidermike007 4

Ask a certain poster above, I am sure he will concur (that means agree) as it seems that he is a big Trumpist (no, that's not an instrument!). Might the reason he has so few posts be because it takes him so long to write one? Probaby another victim of America's failing education system. If you can't see it, then that's your problem. You can feel a warm fuzzy feeling in knowing that there are about 24% of Americans who are as numb-brained and enmeshed in ridiculous conspiracy theories as you. ....including Ted 'Poop-in-his-pants-and-walk-around-like-that-for-a week' Nugent. ....oh, and Jeffrey Beauregard "I can't recall anything" Sessions. You've got great company. The only good thing about Trumpists is they're dragging down the Republican Party and showing Americans what they're really all about (depravity, lying, anti-American). November can't come too soon. ....and then January, when the slew of Democrats take their oath of office, and Republicans get booted out the back door to join yellow-bellied Ryan who (along with Republican sheeple) saddled Americans with trillion dollar deficits every year from 2019. 2
