I am on a 12 month extension of stay based on retirement, issued by Jomtien Immigration.

I rent a condo in Jomtien and the landlord submitted a TM30 when I moved in.

I submit 90 day reports to Jomtien Immigration.

I have had a Letter of Residency from Jomtien Immigration.

I am confident that my current circumstances comply with all relevant rules, regulations and laws.

I have a new female friend who lives in Bangkok. She has been coming down to Jomtien and staying with me on weekends.

My friend has suggested that she and I should alternate – weekend 1, she comes down to Jomtien, weekend 2, I go up to Bangkok, and so on. If I do so, I’ll drive up to Bangkok on Friday afternoons and return to Jomtien on Monday mornings whereby I’d be staying in Bangkok for 3 nights every two weeks.

My friend lives in a house that she owns.

I have searched both thaivisa.com and the internet generally and I haven’t been able to find any information that applies to my possible new circumstances.

Does my friend have to do a TM30 for me only one time or does she have to submit a TM30 on each occasion that I stay at her house?

If (as I suspect), my friend has to submit a TM30 for me only one time, will that mean that I am ‘registered’ in Bangkok? Can I be registered in both Jomtien and Bangkok?

And, what about the TM28?

Do I have to submit one every time I go to stay with my friend in Bangkok?

Do I have to submit a TM28 every time I return to my condo in Jomtien?

In other words, will I have to submit two TM28s every 2 weeks – one on arrival in Bangkok and another upon return to Jomtien?

Hoping to receive some definitive advice.

Thanks.

Beware: around my area, the Immigration Police have acquired nice BMW kitted out with high tech IT equipment. They just turned up at a restaurant. A guy moved had up here from Chonburi, didn’t service a TM 30, he was fined, Bahts 15K. I guy who lives across the main drag from me. They just turned up at his house. They didn’t say much to him, but spoke to his wife. Requirements: Blue house book, Yellow house book, her ID, his passport. The computer in the car; connected to the government system showed everything to be in order. But even so it cause my mate and his wife some stress. BTW this guy hasn’t been out of the town for years and years,

Good advice.

Just because immigration have not checked up on you yet, does not mean that they won't. People not having a TM30 is easy money to collect at the moment. The government needs the money. It will be this year's money spinner.

I thought the max fine was 2000 Baht, in theory, payable by the hotel or house owner.

The 2000 baht an individual homeowner, house master or the possessor.

For a business it is 2000 minimum to a max of 10k baht.

Two years ago I’d been home. Landed in BKK early morning; stayed in a hotel for two nights then traveled up hear by bus; arrived at home about four I’m the afternoon. Following morning of to the IMO. Your late! No I’ve been in a hotel in BKK, call them if you wish. They wanted so much a day of which I can’t remember. I insisted they call the hotel, they didn’t therefore they let me off.

One thing for sure, it’s not new.

In the first case you mentioned the relevant word is 'moved'.  The OP has stated that he will stay with his lady friend on alternate weekends,  which is rather different to 'moved'.  If stopped in a restaurant in BKK he can always say he is there for a meal and intending to return home to Jomtien later. The TM28 is only relevant if he is out of his province for 24 hours or more and is unlikely to be enforced, so in practice he really only has to submit a TM28 if he 'moves', which he isn't doing , he's staying for the weekend with his girlfriend.  If he was unlucky enough to have them knock at the door of his girlfriend's place during the course of the night, she could submit the TM30 the next day.  If that happens then maybe he should consider also submitting a TM28.  I'm with ubonjoe, as always, on this. Why bother.

Issan Lawyers in Nakhon Ratchasima have a petition they emailed to me to sign....the petition will be submitted to the PM, the government, Immigration, and the national newspapers. The petition is about the TM30 form and the way it is being enforced against Farang and Thai owners of hotels etc. If I knew how to post it on here I would. I am a strong believer that us all complaining on ThaiVisa accomplishes nothing. But I also believe by being proactive and actually doing something is better than sitting on our hands. I would have liked the petition to include the huge variations experienced from one immigration office to the next. But this is a beginning. If you do a search on Issan Lawyers you probably will reach the petition and be able to sign it.

For me, I’ll just go to the IMO and do what ever. So it’s a pain. But not as painful as a road block confrontation, an meeting in a hotel lobby or a restaurant.

By law your friend should make a report every time you stay and your landlord should report every time you return to Jomtien.

However, if I were your friend I wouldn’t bother making a report every time you visit; and if they don’t report there’s no real need then for your landlord to report either. Keep it simple.

Jomtien does not want a TM30 when you return from

inside Thailand travel if returning to same address on record.

I travel frequently out of Pattaya and twice a year out if Thailand.  The TM 30 issue has never arisen. Last year when I returned from the UK I tried to report to Jomtien IO within 24 jours but was waved away and told to come back in 90 days. When I travel around Thailand many places to not submit a TM 30 nor ask for my passport.  Perhaps my experience will change in the future but sometimes here in Thailand, I think I in a parallel universe. I just dont experience the ripp offs, scams, hate, bureaucracy, violence etc that many people on this forum seem to experience.

It is always difficult with hearsay stories, but did you see a receipt for 15,000 Baht with that foreigner's name on it and and the reason for the fine?

On the spot? Not sure how such a big fine was calculated.

I travel frequently too, both within and outside the country. I’ve never faced any issues but I’m very aware that things appear to be changing rapidly and harassment is a real possibility now. Harassment designed for one purpose only, the financial benefit of the “authorities “.

Staying within the rules isn’t as easy as it might seem when the rules can be made up on the spot and can change without anyone knowing.

Nor does Bangkok.
