The only  "if" that is  material to the  issue is  that  Musk  has money. If he did  not there  would  little motivation for anything  other  than  regret on either side.

If justice  in the real sense prevails  then I  hope the outcome extends  no further than shared  Court Costs .

the root of "literal" is Latin "literalis", meaning: of letters, or writing

 

since Musk tweeted his opinion, he used letters, hence it is fundamentally (root) literal (made of letters).
