A Thai friend is legally married to a US citizen. They live in Bangkok and her husband recently obtained a 90 day Non O based on marriage with the intention of obtaining a 12 month extension. I have a little knowledge of such visas in general but not the precise requirements so have a couple of questions to assist them with the process. He will be making the application at Chaeng Wattana, Bangkok.

 

He is under the impression that he must make the application within the last 45 days of his current visa's validity. Is that correct and is there a finite limit on that - i.e. could he apply on the last day?

 

As regards the financial requirements: if he goes down the money in the bank route - what are the requirements for how long the cash has to be in his account? Is it 2 months prior to the day he makes the application? Does the money have to remain in his account for any set period after the application - i.e. up until the end of the 30 day under consideration period? If it turns out that the money has not been in the bank long enough, he may be able to correct that by obtaining an extension but, is a 60 day extension available for that visa and if so, is it possible to make his 12 month extension application whilst on that 60 day extension or does he have to start again?

 

As far as I know, the money in the bank route is the way he is going but if he decides on the income route, how long does he need to show the 40,000 per month for? Does his income have to show as international transfers as it does with retirement extensions and is a letter from the bank required? If so, what does that letter have to say and does it have to be dated the same day as the extension application?

 

I presume he will have to have his TM30 registration? Any other requirements specific to Chaeng Wattana Immigration?

 

If it makes any difference - he works freelance for an international organisation and his salary is not paid in Thailand.

He can apply to 45 days early at Chaeng Wattana.

The 400k baht will need to be in the bank for 2 months on the date he appies for the extension and during the 30 day under consideration period.

If he use his income to meet the 40k baht requirement. He will need at least 2 months of transfers into a Thai bank with proof they came from abroad. A letter from the bank will be needed. And a bank statement showing the transfer along with his updated bank book. Normally CW wants the the letter done on the date he applies but will accept one done the day before. And the bank book updated on the day he applies. CW has been asking for a bank letter showing the transfers. Example-BankLetter-Monthly-Deposits.pdf

Thank you Joe. Can he get a 60 day extension to his current visa and if so, is it possible to apply for the 12 month extension whilst on that 60 day extension?

He can get a 60 day extension of the 90 day entry his visa allowed. and then the one year year extension near the end of it.

One further thing - I take it that immigration will insist on TM30 registration to accompany the extension application?  I haven't kept up with the latest developments on TM30 but I seem to remember some offices were more or less scrapping it?

Forgot - this guy travels quite a lot. Once this extension has been obtained - does he need a re-entry permit (or multi) each time he leaves.

It depends upon the immigration where he applies for it. It is not needed if one has been done before after entering the country.

He will need a re-entry permit. He can multiple re-entry permit (3800 baht) when he gets one year extension stamp that will be valid for entry until the date his extension ends. For the 60 day extensi a single entry could be would be enough.
