I Got Scammed By <deleted>

Hello everyone i need your advice 1 feb 2020 i have bought house in <deleted> for total price of 3.6 Million THB as per contract i had to pay down payment of half million THB and reset of the amount of i have to clear within in 3 years with 5.50 interest rate per year and 20000 THB installment per month everything was smooth i went to company official office in Udon Thani i've paid them 500000 THB & 30000 THB and signed a contract under me & my Thai wife name i have paid in Cash to office manger as told by her i must paid in Cash which i have proofs via Line chat Screenshot after signed we was told by her that it will take 1 month before we can move to house cuz they will fix small things in house and paint the walls for us so we can have freash feel i said ok, after 20 days  my wife received call from <deleted> office from Bangkok and lady told her that the manger of Udon Thani office has run away with our money and owner will meet us by 25 Feb which was yesterday and he will fix the things for us i was still claim and i said ok cuz i knew this doesn't have to do anything with us yesterday owner came and we made the new deal he  low the interset as favor i was happy and agree he said within 2 hours he will send new agreement papers for sign and when he sent new agreement he wrote about my down payment of Half million THB that they will not add that payment until authorites don't recover money from her manger after reading that i was <deleted> off and i called him and told him what his doing is not fair he said i must help him get this money from her i said why should i do that i have paid to your company if she run with money thats your problem not mine i was so upset after all this i lost interset buying this house and i told him i need my Full refund within few days and he got mad and said i need to Sue his company to get refund he will never refund until curt don't give him order i told him first thing you hire crimels as your manger and then you also scam your customers he is not answering me anymore and my money is gone for nothing i still do have all contract which mention that i have paid half million and 30000 THB but his said this doesn't make sense and i need strong evidence all this really break my heart and made me very sad please guide me what do i need to do next to get my money back

You can't just get your money back even though it's as bad as it is. Even though it's not your fault, the head guy is not going to give you your 500k back just like that. Morally he should but this is Thailand ....

You already had a new ' lower interest rate ' agreement with the head guy, you had everything in place and could have accepted his request and moved into your new home, he would in turn sue the previous manager and hopefully recover the 500k deposit, that's the 64 million dollar question, will he get your 500k deposit back after a court order or what if the previous manager had already spent the money, if that did happen it would be a long and drawn out process as the court would execute an officer to freeze and recover any assets, then auction them and pay any monies owing back. 

However, you would still be in your new home and paying it off as normal ...

This is a complex situation and as such you MUST engage a lawyer to handle this for you.

If it means suing him then the lawyer will act accordingly.

yes i know that was good deal but as you said this is thailand so how can i be sure that he will sue her and get the money back as promise maybe after i sign the new agreement and he fail to get money back from her thats mean i'm stuck and i have to pay half million THB again

You can't beat buying a house with a bank loan, they do the transfer with you at the land office.

Cuts through all the possibilities of being cheated.

Well that's where your lawyer can work for you on this one, as it stands ... your out of pocket 500k and no house ... why not have your lawyer request a change of clause in the contract that works in your favor.

Have him request a clause that states ' the original deposit of 500k has been paid as required by the purchaser to the said company .... and that you cannot be held responsible for any deposit owing due to the company loss or theft of the said deposit, as such noted that your deposit still stands and had been fully paid....   bla ... bla ... bla ...    at least that way if he can get the contact changed, you live in a house which you are paying for and you don't loose 500k.

2Mbht house,

I paid 10k on signing the contract, and 10k/month while it was being built (5 payments)

The rest was paid at the land office (mostly by the bank), when they handed me the keys, and I moved in that day.

you made a mistake when you paid cash.

maybe they even planned the whole thing when they asked you

for cash payments.

i was also a victim for a crook, who asked me to pay cash for a flight ticket.

i trusted her because the wall on her office was covered with passport

photos of farang, i assumed they were happy customers.

so i paid cash for the ticket. she told me to come back after 3 days,

and when i came back the whole office disapeared !!

SHE CLOSED THE SHOP BECAUSE I PAID CASH !!

sounds crazy but later when i thougth about it, she gained, because her

business was bad and the cash payment could make her live 3-4 months.

anyway i did not budder to go to the police because i knew the police

will tell me that i don't  have anough evidence. only a piece of paper saying

that the ticket cost xxx amount...had i paid by bank transfer the polce

could get her...

if Thailand law is that much weak i'm sure this will be my last time here in Thailand i will try my best to recover money but if i still lose i  better move to somewhere else where you can get justice at doorstep this is ridiculous

Do you have a receipt for your money u paid in cash at the office?

Thailand law is very strong, but only if it pays.

you sound like a newbie, so maybe you better go to the tourist police

and tell them the whole story?

tourist police can speak english and are specialists in helping tourists.

they can give you first impression on if you can win this case in court,

and later refer you to the correct police department where

you can complain about the case.

 

only remember, that if you go to the police, you better be legal yourself,

and they might want to know how you got those 500K in cash.

so if you withdrew it from your bank account in thailand, you better

come with the bank book, it will help them believe you and looking

after your case.

I am not talking about a contract, i am talking about the receipt that you went there and paid in cash. A receipt that proofs the money was paid on that day. Handwritte, printed out - whatever?

I have edited the original post. While I understand the original poster is upset and angry about the situation, the defamation laws in Thailand are strict and his post fell foul of them.

 

Ultimately it is not the company who was dishonourable, it was one of their employees who had gone rogue.

 

Please do not mention the name of the company again.

Or, the cheaper way instead of to hire a lawyer, go to the next police station with all your documents (better your wife goes). They will contact the company. If it doesn´t work you can contact a lawyer later.

Imho there are two only slightly related matters:

- OP made a contract with the company and paid the deposit, now they don't want to honor this contract.

- An employee stole 500k of the company

The only thing connecting these two is that the bank notes have been the same in both cases.

So effectively the company wants to embezzle 500k THB from OP to cut their losses, they are just as dishonourable as the woman who stole the money from the company.

 

Insist that you paid your 500k deposit to the company and that they have to honor the contract. That an employee stole money from them should not be your problem.

You have to report this to the police now!!!!!.You have up to three months to report as a criminal offence, after that it will be a civil offence. 

The company was responsible for their staff and staff actions, so complaints against both parties need to be filed. It will be time consuming and costly for lawyers fees but you should get your deposit and expenses paid when the court finds in your favour.

i'm sorry but what your saying doesn't make sense at all and i prefer jackdd 's reply is well explained , you should not edit and remove company name as they scammed the money and other people should beware of this company for future scams thanks

Yes @jackdd is fully correct.  But be aware that thai defamation laws are such that even if you are fully correct  in your claim that they scammed you, the company can sue you because your posting might hurt their business.
