It's possible that both Trump and Stone could be liable to prosecution for this commutation.  A pardon or commutation can only apply to acts committed in the past.  No one can get a free pass to commit crimes in the future.  So, Trump can commute the sentence for the crimes of which Stone has been convicted.  However, Stone's solicitation of a commutation with the frank quid-pro-quo that he has declined to testify against the President in expectation of a pardon or commutation establishes that the commutation is a bribe incriminating both Trump and Stone since it is in furtherance of an ongoing conspiracy to obstruct justice.  Since this crime is ongoing and Stone has not been convicted of it, the commutation cannot apply to this new crime.

 

While Trump has authority to issue a commutation or pardon, if he were to do so with corrupt intent, as is clear has occurred in this case, then it becomes a crime.  This is easy to understand.  You as owner of your laptop have the power to destroy it.  However, if the laptop has evidence of a crime that you have committed then destroying is obstruction of justice.

 

However, I think it is unlikely that the DoJ under President Biden will prosecute Trump and the rest of his crime family.  The Democrats don't want to appear vindictive, which is why Obama did not prosecute the CIA people who were responsible for torture during the Bush administration.

 

We will have to hope for legal action from some state attorney general against the Trump crime family.  I don't know whether Stone have violated state law, but Trump certainly has.

 

Another point to note is that since Stone's sentence has been commuted he no longer has the right to invoke the Fifth Amendment for questioning with regards to any of the matters covered by his conviction.  That means he could be subpoenaed in the future and if he were to lie again under oath could be indicted for perjury.

I am neither a liberal nor an American but Trump is making a mockery of the US justice as he has of almost every thing else.

Hopefully when his term comes he will find out who his true friends are. He can count them using only 1 finger of 1 hand and that will be pointing at himself.

I think Stone has got a lot of dirt on Trump, so maybe this was a quid pro quo: Trump pardons Stone and Stone is not going to rat on Trump. The last thing Trump needs is another book about all his shady dealings, both as a businessman (and I use that term very loosely here, mind you) and as president.

Except he didn't. It's the courts that make decisions about guilt, not presidents. He is still a convicted felon, according to Mueller. He will sing, eventually, once Trump is out on his backside. Probably put it all in a book, which he's no doubt been working on for some time.

Trump has shown he is about Law and Disorder.

Even Trump's personal attorney Barr opposed clemency for Roger. Barr said that Stone's prosecution was righteous and sentence fair. Oddly, Barr's position was in line with Robert Mueller's defense of his own investigation and prosecution of Roger.

Im almost daily surprised at how much free rein the USA  allows its President ! It allows him  to intefere with all kinds of instruments of the nation- military , Post Office ( <deleted>! ) courts , electoral office, National Parks , etc , etc .... is there anything he is forbidden to mess with as our Prime Ministers are ?

There are Monarchies in the world that are much less tolerant of this sort of open manipulation and meddling with the Nation !

Pardoning would have meant that he could be made to testify in court without fifth amendment claims (right to not self-incriminate).

This got me thinkin about how Stone's testimony,could play a significant role in Durham's  criminal investigation of the mueller prosecutors !
