Hi guys and sorry as this has probably been asked a 1000 times before.

My wife is here on her spouce/partner leave to remain residence permit and I'm just wondering when is the soonest that we can start the process of her becoming a UK citizen?

I'm assuming that you are a British citizen.

 

To qualify for British citizenship as your spouse she must be legally resident in the UK with no time limit on her stay.

 

That means she must have Indefinite Leave to Remain, which as the spouse of a British citizen takes at least 5 years to obtain. You sat she has leave to remain; but at which stage?

 

Once she has ILR she can apply for citizenship at any time; provided she meets the other requirements. The main one being that she must be in the UK when she applies and during the previous three years have spent a maximum of 270 days out of the UK with a maximum of 90 days in the final year.

One other thing, sorry.

My wife is on a spouce visa here in the UK and I'm a British citizen. 

It says that for indefinite leave to remain she has to have been staying here lawfully for a period of 5 years and she can apply a max of 28 days before her 5 years are up but the application could take upto 6 MONTHS. 

Is this right as it could mean that she would have to leave the UK whilst waiting on a decision?

I must be reading this wrong surely.

I have just submitted ILR application for my wife. Your wife will retain her residence status while waiting for the result of her application so she can stay in the UK during that period.

Spouse visa or Further Leave to Remain?

 

If a spouse visa she will need to apply for FLR after living here for 30 months; see the relevant parts of Family visas: apply, extend or switch.

 

If she already has FLR then she can apply for ILR when that expires after 30 months; see here.

 

As @bigyin says above, with her FLR and ILR applications her current leave will automatically be extended until the decision is made on her application.
