I always wondered if my kids could one day be of use to me. I am considering applying for an extension based on my kids rather than my wife and would be interested in feedback on the various differences in requirements.

Less questions and paperwork but mother needs to join and otherwise you need custody first. The extension is to be with your child or wife at the end.

I don't know about CM, but in Sisaket the rules for "married" or "father" are basically the same. 

 

The main requirement, on top of the money, is to prove that the child lives with you. 

 

Immigration came to our home, interrogated 2 witnesses for an hour, and took multiple photos. 

 

After that, it was just a matter of waiting, more than a month, for the bureaucracy to do its work...

He need to obtain custody trough court first to do that. Then can get visa til they are 20.

Did the Children get put in an orphanage after he left Thailand ?

But CM immigration are only interested in 25 bits of paper in an envelope, then all the requirements are out the window.

 

Quite frankly I'm tired of foreigners excusing their merciless extortion of applicants.

No other counties immigration service behaves like this.

Not at all if it comes to non-o child. Very straight forward / hassle free paper wise but need to wait 6 hours lol.

Criteria is either bringing in mother or becoming legal parent first with custody. Same count for getting the visa on this at embassies.

All the embassy/consulate require is the kids birth certificate and a copy of their house book.

Had many Non-os for my kids.

Immigration wanting custody documents, is just another excuse to say NO, it's never been a requirement.

You will have produced also signed copies by your wife and her ID card. Otherwise it is nonsense or not recent. Or fraud.

Did you make a genuine application with your own Children, or did you apply with a dodgy application using your wifes children ?

Out of curiosity, what does one do if:

1. Children are under 18.

2. You are the sole guardian.

3. You don't have 400k in the bank

 

Do you still have to leave the country and put the children in an orphanage or what?

What year did that happen. Before August of 2014 the clause of the police order was different.

It certainly has been allowed since then.

3. You can also use the 40k baht income option.

You could get a non-o visa based upon being the parent of a Thai and you can get 60 day extension of the 90 entry from it.

There is no written maximum age for an extension based upon being the parent of a Thai.

It only exists in the minds of some immigration officers.

If 50 or over there is an option for them to support you instead of you having to show financial proof.

Was never required for Non-O looking after child.

Not in Suvannakhet, not in Saigon.

I stand to be corrected, but as far as I'm aware, if you are legally married and the children born in wedlock, then the Father has the same rights of parental responsibility over the children as the Mother.

 

It's only if you weren't legally married, or the children were born out of legal wedlock that the Father would then need to obtain a Court Order, legitimising himself as the Father and the right of parental responsibility.

Excellent! That is why Prakarn Sankhom pay me 600 baht every month for my kids. Let's hope Immigration are on the same wavelength.

As an aside, the people who work at Prakarn Sankhom are always so pleasant and helpful with everything, unlike the greedy, corrupt pigs at Immigration. If only whomever manages Prakarn Sankhom could take over at Immigration, life would be a lot easier. ????

I've done it many times but it requires appropriate documentation. 

I'm divorced and have two kids and our divorce papers state we have 50/50 custody. You should have some proof they are living with you and that you have either 50/50 or sole custody.. 

You will need the mom's cooperation as you will need

  • Legal documents that show you are supporting them or have half custody. 
  • Originals of the kids' Thai birth certificates and their tabian baan (house registration).
  • Pictures of yourself with the kids around the house and in their uniforms outside their school.
  • A letter from their school certifying that they attend the school.
  • Proof of your income just as if you were getting Non-immigrant B visa based on a Thai wife and same standards apply (not sure of the current income requirements).
  • A copy of the mother's ID with her signature.  


I think that was all I needed when I used to do it this way.

How are you screwed? You are married, for Pete's sake so you can get the visa no problem! The process of getting it based on your kids is a lot more onerous. And it should be obvious that the kids have to be minors.

Strange I know someone who has done it for years in CM and another told he can do it this week (confirmed on Friday). 

Was he not the legal guardian or something strange ??

I get mine for my child every year since 2011 , I have sole custody after divorce, paper from amphur,   Child to attend immigration , money in bank much the same marriage , papers same as marriage, birth certificate of child and ID and tabien baan , 

no easier than marriage , no harder.       Only exception Is if wife is being a bitch you not need her help 

got mine at 4 different places

chiang mai 

buriram 

hua hin 

bangkok
