Some advice please guys,posted this in another thread but thought I would do it as a new Topic.

My 30yr old TG applied last June for a visitors visa to Aust at that time she was in a relationship with another guy(aussie) and he failed to fill out the application properly hence it was refused with no appeal allowed.

He put her down as being currently employed at xxx supermarket in Administration (at which she did work some 6 mths previously) and also failed to put down her parents details and where her parents live (not a smart cookie this bloke) and got her to sign the app and submitted it, I can only assume with fingers crossed :o she was refused because they could not verify her employment and no contact details for next of kin.

She is still unemployed and is helping mum out(unpaid) on the plantation down south.

I am supporting her so she has funds coming in.

Has anyone resubmitted an application similar to these circumstances and is there any hope of approval?

After reading all the great information here I have all the documentation required to back up our application ie Stat Dec,photo's,phone and sms records,tax returns,wage slips,mortgage papers.Her passport,bank book,ID card.

Any advice appreciated.

Tough one this one....

First you are assuming that those were the reasons for the rejection...problem is you dont know the reasons.

Second, You will have to put it in the application that she was refused previously and they will have it on record. This is going to make them look at it very closely.

Third, the last application was in last July less than 12 months ago with another fella....this will raise suspicion with the Embassy as to her intent.

However dont let this deter you...just be aware that you will need to make a fairly strong application.

Her being unemployed is not a problem as long as you will support her while she is here and the relevant section of 48R is filled out, She will need to list her last job on the application, Most girls who have worked in the bars bend the truth here a bit, there are a lot of cleaners and housemaids in Thailand :o If the supermarket job was her last job then put that in...they dont ask for a long employment history.

Make the application as strong as you can and good luck

I agree with Graham on his points.

On the occasion that her application was rejected, she should have been given written reasons from the Embassy for the refusal. This will be the area that needs to be properly addressed in any future application.

As she is now unemployed, she will need to give a compelling reason to return to Thailand at the completion of her tourist visa.

I also suggest that you submit a comprehensive covering letter explaining the nature of your relationship and how you see it developing into the future. The relationship may be genuine from your side but she also needs to indicate in her separate covering letter that it is also genuine on her side.

(I'm assuming that this is the case and that the relationship is more than just friendship.)

As she was in a relationship less than 12 months ago with another person, you now need to convince the Embassy that you are both fair dinkum.

Tourist visas are usually relatively easy to obtain but in this case the application may need to be stronger than normally required.

Thanks mate for your reply,I have seen the rejection letter and that was the reasons stated on there.

Many thanks for all the great advice from the board,the visa was approved at the end of May and she is now tucked up here in freezing cold Melbourne town (probably wishing she was at home right now :o )

Another question if I may please? what is the process for the second visa?this current one is for "no further stay"

Usually the visa is stamped "Not valid for further travel" this does not mean she can't apply for a new visa at a future date. My TW had 8 of them before we applied for residency. She MUST leave Aust when or prior to the current visa expires then apply for another here in Thailand or wherever. Edited by bdenner

Oh! One more thing. So long as you don't break any rules your next and subsiquent visa applications will get easier.

Since most tourist visas issued in the past year or so are for a year, multiple entry, my guess is that the minimum time visa she got reflected the prior refusal.

This time, after she has returned to Thailand, her visa request is much stronger as demonstrated by her timely return. I would certainly try for a one year multiple entry even though she may not use them all. Every three months as visa run is required. A one day hop and return to NZ is the cheapest way if she wants to stay more than 3 months.

Keep in mind, that many Aussies have encountered resistance on a third visa attempt for their girlfriends to visit Oz, the rationale being that the relationship should have evolved to the fiance level by the third visit and there have been many turn downs on the third try.

That's an interesting twist I guess things have changed substancially since we played the game. In saying that it was the embassy that advised us to apply for residency after the 8th tourist visa.

It used to be 3 visas, but that was before the issuing of multi entries as a practice...

Some are still getting the 3 month first time around and the a multi entry....we havent tested the waters on further visas after that at this point....most of us are getting married by that stage... :o

I havent heard about the 8 visa issue, but it may have changed. The Dept reserve the right to limit the amount of tourist visas issued to one person but they havent set a limit

It wasn't a directive after the 8th. They just advised that it would be easier on us to travel under a residency visa, the application was basically rubber stamped during one of my work shifts. At the time I was working on an offshore facility in the Gulf on a 28 day roster.
