Child/Parent Visa

Featured Replies

My Thai wife is expecting next month. And somebody told me that if I have a Thai child I can get some kind of a child visa. He told me that only thing I need is the birth certificate and proof of funds - 400,000 baht in the Thai bank account without any 2 month like they have with marriage visa, is this correct?

Oh dear.

Just get a 12 month extension because of Thai Wife.

That is all they will give you.

It is possible to apply for a one year extension of stay (it is not a visa) based upon being the parent of a Thai and the 400k baht only has to be in the bank on the day you apply verses 2 months for one based upon marriage.

Marriage visa a bit complicated. First I need to send the marriage certificate to Washington DC to get approved that it is a legit document. Then, I need to send that to Thai Embassy in Los Angeles to get translated and approved. Then, I need to open a bank account and wait 2 month. Child Visa sounds a lot easier.

You don't have to do all of that. You can do a affidavit at the US embassy as a self certification of your marriage certificate. Then have it and your marriage certificate translated to Thai and the certified by the Department of Consular affairs that a Amphoe will accept to register your foreign marriage to get the Kor Ror 22 marriage registry that immigration requires.

From the embassy website. https://th.usembassy.gov/u-s-citizen-services/local-resources-of-u-s-citizens/notaries-public/

"Affidavits
Oftentimes the Thai government requests the U.S. Embassy or Consulate General Chiang Mai “certify” documents listed under “services we cannot provide.” Please note the Embassy and Consulate CAN notarize an affidavit which may or may not satisfy the Thai requirement for “certification.”

It's actually even more complex than that if you want to legalize your marriage cert while still in the U.S.

The required steps for the marriage certificate:

1. Certified by California (or your state) Secretary of State

then

2. Certified by U.S. Department of State in DC

then

3. Translated to the consulate standards (they're picky)

only after that it can be

4. Legalized by the Consulate and become admissible in Thailand

I received this email from Bangkok

"An affidavit is a sworn statement which requires an appearance of a person who is making it so it is not possible to do affidavit online. Should you wish to request for an emergency notarial appointment, you may request the appointment directly here.

I don't think affidavit is an emergency. So, the only options I have are the mailing the certificate or just wait for next month to do the extension. Can I get an extension to my 90 days ED visa?

They have been doing them and needing to get your foreign marriage registry could be considered as urgent.

I thought of something else that could be a problem if you were to try to apply based upon being the parent of a Thai. Immigration will ask for proof of marriage to confirm you are married to your child's mother. No sure they would accept one from the US without a Kor Ror 22 to prove it was registered at a Amphoe.

I suggest you checking with the Amphoe about the foreign marriage registry to find out what they require. Some want a certified copy of your passport photo page that would have to be done at them embassy. It might save a trip to the embassy to have it done later.
