Is police harassment in the Thong Lo area still a problem?

this not how law works, there is principle of presumption of innocence at first and prosecution must prove that you have imported it illegally. I can tell you more, shops at Sukhumvit that sells this stuff is connected with police for sure, police is not givin a sht about small el cigs as half of Thai youth have them, some very hungry cop may harass some ignorant drunk tourist maybe at max, if you live here situation is different.....

That person who bought it, illegally, from an illegal seller, would, obviously, be in possession of an item that was illegally imported, that is the offence.  That he bought it from a third party here doesn't make it's purchase legal.

It's not obvious at all. There would need to be a separate offence of possession, just like there is for cocaine for example. If there isn't a specific law saying possession is an offence, then it isn't an offence.

There is that specific law!   It is covered by Section 20 of the Customs Act that prohibits the import of electronic cigarettes as this section covers the category of goods that have not had tax levied on them and therefore their possession is illegal.  

 

The offence is possessing an banned item that has, by definition, been illegally imported (unless it can be proven that it was acquired prior to the 2014 legislation).

Yes, you can bring what you want to the court after having spent weeks in the cops cell...

 

People living in Thailand and thinking that they have any chance against cops / laws are just so funny...

An illegally imported item isn't the same as a banned item. It's illegal to import dildos but certainly not illegal to possess them.

It's attitude like that that encourages cops to act the way they do. If you've done nothing wrong and are clearly not a sap who just pays up they always leave you alone.

There's nothing in section 20 of the Customs Act that makes the possession of e-cigarettes illegal:

That section requires that duty is paid as required under the Act.  Duty cannot be paid on e-cigs as they are illegal, therefore if you are in possession of an e-cig you are in possession of an illegal item, i.e an imported item on which import duty has not been paid.   

 

If you don't think that's an offence, so be it, but it is, that's why there are prosecutions.

The problem is you're not presenting any evidence for your assertions. What law makes it illegal to be in possession of an imported item on which import duty has not been paid?

There are clear notices in many Pattaya bars banning them due to illegality.

I stopped going to Soi Cowboy  or past Asoke years ago.  Especially late at night. Since they cleared all the food stalls and vendors that whole area  became joyless and the undercover police and spotters became painfully obvious. Worryingly the cops were using falang and Arab or Russian volunteers as informers and spotters.

"smoking while driving" ? Is that actually an offence in Thailand?
