Good afternoon

In condo act is stipulated that there must be minimum 3 and maximum 9 committee members

I am told the law changed and now 5 committee members is the minimum

Would anybody have the right information ?

As far I know (and a google search shows same) the last amendments to the Condominium Act were 2008, and as you say, it says 3-9 committee members.

 

Unless someone can produce or link to an amended Act, I think you can take it that the Act, amended in 2008, is still current.

 

I imagine if any changes have happened, it would be mentioned. and the new act published on legal websites etc.

There has been no amendment to the Act since 2008- so it is still 3-9.

Maybe your condo passed a resolution into your regulations to say that for your condo 5 was the minimum.

3 to 9 says the Condo Act. But at an AGM co-owners can vote how many (3 to 9). At our condo we always vote 9 as usually several will quit during their term. So we have some buffer.  

Perhaps check your condo by-laws, rules and regulations.  It may be stipulated that your associates requires five…….   Just a thought!
