Updated TM 30 information

Hello,

 

Just arrived back in Bangkok and recently signed a lease for a condo. My landlord seems to not want to do the TM 30 as she is seemingly older, is just coming off as a bit clueless and hands off about it all, after we sent her the online instructions, she basically just brushed it off. My wife has offered to forge the process and do it as the landlord, and is dealing with the agent (the landlords friend) on this matter to get the house book document.

 

My wife sends line messages to the group and they don't even read them and or barely reply.

 

If the don't send the house book info by tonight, my wife says she will contact the agent and explain, maybe this contract should be terminated because the landlord seems to not be able to rent to a foreigner, and she will get fined.

 

I have read some older threads where people have mentioned the TM30 not being needed any longer for extensions at CW, etc..

 

What is the latest news on the TM30?

 

And if needed, do I have recourse to get out of the lease?

 

Not really related, but they also offered to add some things to the room and fix the low water pressure in the bathroom, etc.. But I am a bit skeptical they will even do anything now after this situation.

Breach of rental contract by landlord is not the case because there is no chapter in the rental contract mentioning this duty.

 

Its a breach against a regulation between landlord and the legislative of Thailand. You are only third party.

 

Saying its not your duty wont help practically. 

 

Due to the fact that TM 30 is still needed I strongly advise that you deal with the TM 30 by yourself.

This happens each day 500-1000 times.

 

And:

Terminate the lease and move on.

I see, well, I guess we will wait until today, and see if they give the house book and proceed from there.

 

Can the TM 30 be done without their house book? What is exactly needed to do the TM 30 "by yourself". And will I get a fine at CW when I go to do my extension?

 

We have a copy of the landlords ID (they are Chinese).

 

Losing my deposit will be the last resort, such a shame they were so helpful and promising everything when they were about to take my money, then afterwards, they basically disappear.

A signed copy of the house book would be enough. No need for the original house book. Also a signed copy of their ID card.

You will also need a copy of the lease or rental agreement.

The ID copy we have was not signed. So, we asked for signed copies of both. Let's see how it goes.

 

I guess, my main concern is, what happens when I go to do my extension at CW and we don't have a TM 30 to show??

What type of extension are you applying for? 

Sounds like you just changed address and moved into your current condo?

It would be an extension based on marriage. NON O. I just came back into the country and this is the condo I found.

I have never had to reach out to an agent before, guess I have been lucky. 

 

If you have one you can recommend, I will definitely consider it.

Have never done a TM30.

 

Most likely best to follow uj advice and try and obtain those basic items and do it yourself. 

 

Its a pity that your landlord and their agent has been uncooperative.

My partner has few rentals and currently one is rented by farang.

The agent attends to to TM30 for that guy as should be the case. 

 

Your situation comes up often and just a shout out to folk to always check if your landlord will do a TM30.

Yeah, I hope we can obtain those documents and just do it. 

 

Also, it is a bit sad they just basically disappeared after taking my two months deposit and first months. Who knows if they will still follow through with the additions to the space as well. I'm guessing, if we can't get these papers, chances are super low.

 

Definitely, lesson learned about making sure to check on the TM 30 before handing over money. Sad thing is the agent did mention the TM 30 when we were signing the lease, like she had plans to help the process. Almost, like I need it in writing on the lease moving forward.

Don't know an agent in Bangkok sorry I did mine in Pattaya, maybe someone with a contact could inbox you on here.

 

Maybe you could ask the landlord politely if he is unable to help you with TM30, maybe show him a link how It's important to have, would he cover the cost

 

At the end of the day you were talking about losing your deposit so better only to lose B1000 and get it done

Yeah,

 

I agree about the deposit vs 1000 baht. But, tbch, this whole thing has put a bad taste in my mouth, from the negligence, empty promises, disappearing and not responding after I paid the money, etc..

 

If there was a way to fight it, I probably would, but of course, the Thai wife is against conflicts, and unfortunately, I have to succumb to her way vs my way. Guess, these are the drawbacks of living in a foreign land where you don't know the language enough.

Think its best to talk with an owner of a place you are interested in for long term regarding TM30 before signing a rental agreement. In my case the owner was quite clueless as well - I printed tm30 forms for him to look at and screen shots of immigration websites instructions for landlords/owners and instructions for foreigners if owner does not want to deal with immigration. Obviously find another place if they are not interested in giving ID, Tabien Baan copies..... All went well, he gave me everything I needed and signed - TM30 done in 20 minutes at immigration ( Phuket ). They do like seeing that address notification slip in your passport come extension time.......

Every time I have rented here, seems like landlords always requested two months as deposit?

Update:

 

So we were able to get both the owners condo house book and ID signed. My wife went ahead and filed as the owner. She uploaded all necessary forms on application. First time, as we weren't sure what to expect as far as completion. She just showed me when we log into the site, you see my name and info under the owners directory page on the TM 30 site.

 

So when you mentioned this: They do like seeing that address notification slip in your passport come extension time.......

 

What do you actually mean?

I did mine in person at Immigration, when they submit it all on their system, you get an Address Notification slip - keep it in your passport. Yours was done online, take a screen shot of it and tell them your tm30 was done online when you go for your 1 year extension.......

Is there a stale-date for the screenshot?   For example, if you move into a new place and get the landlord to file a TM30 online right away and sign a print of a screenshot - and his ID and house book - can you hold onto it all for six months and then submit it to Immigration  for your retirement extension?

Yes

It would still be valid since it will have a the date your arrival at the residence.

Immigration always stapled a notification slip of paper into my passport for an extension.

I have my appointment with Thai Immigration tomorrow and I just found out I need the TM30. But I don't have one. CANSIAMYou said you did this at Immigration? But I guess you had the needed documents from the Thai address owner?

 

I just have a receipt for one months rent from the hotel. I guess the TM30 is needed to change from a visa exempt entry to a Non-O visa?

Try and get a letter from the hotel stating the monthly rent and maybe a length of term you'll stay there, bring that receipt as well. Ask the hotel if they have reported your stay to immigration, they should have soon as you got there.  Yes I had a rental agreement, landlord ID, House registration number and a filled out TM30.

Thanks. I have a receipt from yesterday where I paid the next months rent. Unless the hotel owner can get me the TM30 by tomorrow morning, I will just go to my appointment tomorrow and hope they will do my Non-O without the TM30. I read another persons comment where it wasn't a problem. Or else I will probably need to I make another appointment for next week. 

 

I sent the hotel owner an email asking if they could email me a copy of the TM30. Hopefully they will come through by tomorrow morning, but I kinda doubt it.

I have recently moved and am wondering if anyone knows if a print out of the online registration from the combined apartment complex / hotel in addition to the place manager's identity card / Tabian Ban will be enough for the Immigration to be issued "Notification of residence or is the practise different from one Immigration office to another?

Many hotels, condos etc do file a TM30 registration.

A screenshot grab of that will satisfy immigration for extensions etc

You shouldn't need anything to show immigration, if the hotel has entered you in the system then immigration will see you in the system. The email may make you feel comfortable that the hotel has entered you, but immigration will simply check the system to see if you are there. There is no requirement for a receipt of being entered, if you are not in the system, you are not in the system.
