Historically, no democratic institution has torn up the constitution. They have rewritten it with electorate support. Remember the People's Constitution of 1997? The first ever that was drafted by an elected assembly. 

But there is NO reason to suppose that they cannot do so, especially if they are supported by the people of Thailand.

    They might raise their eyebrows if that party was predicted to win. Especially if that party had  already been prevented from winning by coups and interventions in three previous elections.

It is a matter of being well organised.  Stalin said the people who vote are not important, all depends on the people who count the votes (as we can notice in the US elections)
