Visit UK on tourist visa, fiancée visa or work permit? Which????

I would like some advice please

Is it possible for a Thai lady to visit the UK on a work visa or work permit?

We know each other very well for over 16 Months now and spent 9 months travelling together around the far east, I returned to the UK to work and she started a college course. We will get married if she thinks she can live in the UK!

She is planning to visit me in the UK after she has completed her college course in October.

She is studying at a tourist college in Chiang Mai and has completed 3 months of the 6 month course. It is a tourism and hotelier course and she is about to commence 3 months work experience at the end of July in a major hotel in CM

But

I can get the owner of a hotel in the UK to sponsor her and allow he to train or work or voluntary work in a hotel here in the UK

Her college has just decided after numerous appeals to allow her to do her work experience in a hotel in the UK if she has a job offer. This is not a problem as I work in my family run hotel.

Our dilemma is - can we get a work visa or work permit to allow her to visit the UK for 3 to months. With the backing of her college and the offer of full sponsorship, accommodation and a job here in the UK. Is this possible?

I cannot find any information on this type of visit to the UK from Thailand on the net.

Is this possible to do? Does anyone know how easy this is? How long is might take? How to apply?

I would like her to visit me for 3 – 6 months this year. And I want to do what will be the best chance of getting her to the UK this year.

She asked a Chiang Mai Visa agency if this was possible and they said YES if we could get the documents, job offer and sponsorship from the UK hotel. But I cannot find any details how to best apply for this type of visa.

Should we:

  • Apply for this work visa sponsored by hotel in the UK and part of her college course NOW.

  • Apply for a tourist visa when she has completed her course in Oct.

  • Apply for a fiancée visa when she has completed her course in Oct.

  • Apply for this work visa sponsored by hotel in the UK and part of her college course NOW and if it fails then apply again for a touist visa in October

  • Can any Visa agencies in CM help us with this situation.

  • Any advice would be greatly appreciated

A tourist visa will not allow her to work

For a Fiancee visa you will have to demonstrate your intention to marry within the following 6 months and her intention to settle in UK. She will not be allowed to work until you are married.

She is unlikely to be successful for a work visa if her current course is not a university degree course

She could apply for a student visa if she can find a relevant course. It will have to be booked and paid for up front at international students rates. She will be allowed to work part time but must attend her course.

You should decide which is the most appropriate visa for your intentions and go for that.

My advice would be to avoid agencies in Chiang Mai unless you are absolutely sure they are acredited. You should be able to make an application between you with a little research.

Can you offer any further advice on applying for a work permit for a thai national to work in the UK?

There is lots of information in general on the net but I wonder how best to go about this and do many Thai ladies get work permits for the UK?

To apply for a work permit you will have to prove you have a vacancy, you will have to advertise the job in the press and the job centre for a period of time and show proof that you have done so, you will have to interview any applicants and state that there were no suitable respondants meeting the qualifications for the job and why. State why you think the person from overseas is more suitable than others and why your business needs her skills. Present why her skills and experience are not available locally. You will need to present the job description with payment and benefits offered. It will have to meet minimum wage and other regulations.

My opinion is that hotel and hospitality staff are plentiful in UK (especially as UK is now flooded with eastern europeans). It will be difficult to convince them that fluency in Thai language is necessary to operate a hotel in Dorset (or wherever)!
