Surin Immigration Enforces Law for housing Foreigners

On July 11, 2023, it was reported that under the direction of Police Lieutenant General Thanawat Poolsawasd, the Surin Immigration Bureau has enforced investigations and publicized Section 38 of the Immigration Act B.E. 2522 (1979) for businesses providing housing to foreigners.

 

This law covers hotels, resorts, guest houses, and other residences within their jurisdiction, in line with the directives of the commanding officer, to prevent and suppress violations of the Immigration Act, reported Siam Rath.

The agency clarified the legal provisions, procedures for accommodating foreigners, and penalties if violations are found. It also advised on how to report foreign accommodation and provided channels for those seeking help or reporting suspicions related to foreigners.

All foreigners must be reported to immigration. (TM 30)

The law has been in place more than 40 years.

Haven't you ever seen Thai cops taking pictures of themselves at road junctions? They do it to show their boss they're not watching telly in the police box. Immigration officers need to chase down some clueless but mostly innocent foreigner for pics to show their worth. It could also just be a slow day at Siam Wrath.

Not all foreigners are subject to reporting under Section 38 of the immigration act of 1979.

 

An actual translation of the Immigration Act can be found here: http://www.samutprakanimmigration.go.th/downloads/Immigration_Act.pdf and it states that the reporting applies to foreigners on temporary permission of stay. Permanent residents are not on temporary permission to stay and are therefore exempt from reporting under Section 38.
