As for this indictment, videos, emails, memos and messages, plus multiple witness statements from trump's own people, are FACTS. The only point of the trial is to let trump make some excuse up, and then if at least one jury member believes what will be an obvious lie. Technically your point about trial and evidence might be correct, as Al Capone must never have had anyone killed, but he did cheat on his taxes....hence, jail.
