I have been having this debate with denialists on FB over and over.. The 'I calculated my exemptions and believe I have no liability' crowd are very strong.
The Oz super guys are the heaviest in denial.. Pointing over and over to the 'soley' in the DTA without understanding (or rtaher refusing to) that if Oz chooses not to tax, that is then untaxed income.
He uses only the finest ingredients.
I wouldn't expect a mate to serve up anything containing anything less than the finest ingredients. Neither would I expect a mate to charge. Some mate.
Lets try for the last time, for all of you non Americans and ignorant Americans, to explain reality.
Under the law of each and every American state and territory and the Feds (as best I can recall, feel free to check) there is NO CONVICTION UNTIL SENTENCE HAS BEEN IMPOSED. In NY, it is called "Final Judgement of Conviction"
The Trial Court retains COMPLETE JURISDICTION over the case UNTILL SENTENCE is pronounced and the FINAL JUDGEMENT OF CONVICTION has been ENTERED in the docket. Once that happens, the Appellate Court takes jurisdiction to review, although the Trial Court retains jurisdiction to modify the sentence downward, or even grant what is called "a judgement notwithstanding the verdict".
Until the FINAL JUDGEMENT OF CONVICTION is entered, the Trial Court of course is free to do whatever it wants with the trier of facts findings, to include dismissal of the entire case, dismissal of charges or counts.
With that unquestioned and unimpeachable summary of the law in mind:
Donald Trump has not been sentenced. There is no final judgement of conviction. He is, as a matter of law, NOT a convicted felon. He retains his presumption of innocence.
Anyone who claims Trump is a convicted felon is a liar or a propagandist.
* Unless that income is exempt taxation in Thailand due to a DTA.
Should be:
* IF it is assessable income. Income is NOT assessable in the many cases, e.g.:
1) that income is exempt taxation in Thailand due to a DTA
2) savings/income before 2024
3) principal amount of investments with zero gain or with loss
etc.
