Was your 'chum' convicted in a court of law?

If not, just more of your nonsense.

No, they put what they know to him, if you are bang to rights you can pay the 1000 quid fine, if you deny it and go to court that is your option, probably at your own expense.

My chum did not pay the 1000 quid fine because he/they proved he had a brain operation, and they didn't know about locked pension as his sister in the UK did all his paperwork, he couldn't. I have since done his paperwork for many years to keep him out of trouble..

My chums friend had similar, but he knew he was on the fiddle, he paid the 1000 quid and now lives in the UK...

Though this was years back now, but as I said, if you know it all, great, but don't dismiss actual facts, eh...🤗

That little sentence that says " You also risk having to pay a penalty or may have legal action taken against you "

Is a misprint and shouldn't have been written 😀😀

There will be a few confused faces when State Pension payments are suddenly suspended

I'd prefer the sentence to be more accurate and say ..........

"You also risk having to pay a penalty or may have legal action taken against you, but you would be the first"

Oh, answer this, if you are in the UK paying tax, and you send your tax return in late, what happens..?

Do they fine you 100 quid on the spot...?

They did many years back when I was there.........🤭

So, a fiddle pension is waaay more serious than a late tax return, eh..:whistling:

You are never 'bang to rights' ........ always deny, always go to court if they insist.

That's my policy, and I win every time, mostly the other side caves, but the two that didn't resulted in 1 win against the law society (disagreement over solicitors fees settled in my favour), 1 win against the police (7,000 pounds compensation paid to me).

The interesting thing about the UK police, they often start court proceedings then don't turn up to the court, so you win by default without needing any evidence.

(Off topic) But can't really answer,

The only times I filled in a tax return was to claim money back (3x), I've always been taxed at source with no other income. So no tax returns ever required, unless I have an allowance and don't want to wait until next year to get it back.

I know of no new powers granted in 2024, and we aren't in 2025 for another month.

They may get new powers at some time in the future, but unlike you, I don't claim to know the future.

You need to add in addition to being dead, a reason to believe that fraud is being committyed, any number of other offences are being committed and State Pension can be suspended until investigated and all found to be in order.

You would be hard pushed to prove malfeasance when it comes to the protection of Public Funds, far less be sacked for it.

Perhaps the question you should ask yourself. Is it possible that lazy Government employees could be incentivised to highlight possible fraudulent claims.

The second part of that nonsense, is that it will not be lazy Government employees that are doing the actual investigations, it will be a team of accountants.

The current UK Government, is in a bit of a financial pickle, even before the last Budget works its way through the system. Desperation measures will be introduced in time for the new Financial year.

As always, you are free to believe whatever you like, and that nothing will have a direct on you.

The problem with you sunshine, is this you do not have a clue on DWP regulations.

Read them up instead of wandering off in some dream state. There are no stoppages enforced or otherwise,(excepting PoL)  which unfrozen will not receive    Receiving unfrozen OAP pension in TH is not fraudulent ,and I might add, if it were ,no action would be undertaken, ANA freezing

I find it difficult to believe some on here dismiss the DWP written, printed warnings......😋

I find it even harder that people do not read DWP printed information ,(warnings too ) that do not effect OAP pensions

Is none of this correct?

1. Legal Consequences

Claiming to live in the UK while residing in a different country where the pension is frozen constitutes fraud or misrepresentation. Specific legal repercussions include:

Prosecution for Fraud:

Under the Fraud Act 2006, providing false information to the Department for Work and Pensions (DWP) is a criminal offense.

Penalties may include:

A criminal record.

Fines or repayment of falsely claimed pension increases.

Imprisonment (typically for severe cases of fraud).

Investigation by the DWP or HM Revenue & Customs (HMRC):

The DWP routinely monitors pension claims and may conduct investigations, especially if they suspect fraud.

Data sharing between countries under reciprocal agreements can reveal discrepancies in residency.

2. Financial Consequences

If the fraud is discovered, the pensioner may face:

• Repayment of Overpaid Pension:

• The DWP will demand the repayment of any overpaid pension resulting from incorrect residency claims.

• This can include years of back payments, leading to significant financial hardship.

• Loss of Pension Rights:

• The DWP may suspend or terminate pension payments entirely if fraud is proven.

• No Future Increases:

• If found to be residing in a “frozen” country, the pension will revert to the level it was when the person left the UK, without further increases.

  • Thumbs Up 1

if it is a non sanctioned or disqualifying benefit

If a benefit is non-sanctionable or disqualifying, it means that even if there is an issue with your claim, your benefit won't be reduced or stopped

Are you saying that filing a late tax return form, where the fine is 100 quid, is more serious than fiddling, stealing, 60,000 quid from the DWP, that figure is from you..........?   🤭

Sensible answer only ..............🤕................🤭
