Hi

I’m from Denmark, my wife is Thai, we got married in the USA. We registered the marriage in Thailand through a Kor Ror 22. I’m now at the Amphur and the officer says we can’t get divorced in Thailand and that we have to get divorced at the US embassy.

Is this correct?

My understanding was that even if you married abroad you can still divorce in Thailand if the marriage is registered here and we’re both residents here.

I think it's correct that the amphur can't divorce you. Not sure if possible through the embassy, but I think you can get divorced by the family court.

The best thing to do is seek professional legal advice.

The officer is right. Divorce where you were married only.

That is not correct.

You can get divorced in Thailand even if you married elsewhere and did NOT register it here.  I know this because I former neighbor of mine divorce his wife, who he married in the USA, and never registered it Thailand.  He did have an attorney representing him, which he told me was expensive, but you can get a divorce in Thailand.  Get an attorney.  (an alternat method would be to go to Guam and stay for seven days, declare residency and get your US divorce there).

It's what I said. You can't do it in Thailand. (You're free to hire an attorney to do the job for you outside Thailand)

Yes, you can legally get divorced in Thailand. Since both you and your Thai wife currently reside in Thailand, you are eligible to file for divorce there. Here’s a breakdown of the process and requirements:

Types of Divorce in Thailand

  1. Uncontested Divorce (Administrative Divorce):
    • This type is applicable if both parties agree on the divorce and have no disputes regarding issues like child custody or property division.
    • You must both be present at the district office (Khet or Amphur) to register the divorce.
    • If your marriage was registered in Thailand or at a Thai embassy, this option is available

  2. Contested Divorce (Judicial Divorce):
    • If there are disagreements regarding the terms of the divorce, you will need to file for a contested divorce through the Thai courts.
    • In this case, at least one party must provide valid grounds for the divorce as defined under Thai law

Requirements for Filing

  • Residency: At least one spouse must be lawfully residing in Thailand.
  • Marriage Registration: If your marriage was not registered in Thailand, you can still file for divorce, but it must be through the court system rather than an administrative process
    .
  • Personal Appearance: For an uncontested divorce, both spouses must attend the district office personally. For a contested divorce, only the filing spouse needs to be present; the other can be represented by an attorney

Conclusion

Since you and your wife are living in Thailand, you do not need to return to the USA to finalize your divorce. You can initiate the process directly in Thailand based on whether your situation qualifies for an uncontested or contested divorce. It may be beneficial to consult with a local attorney who specializes in family law to guide you through the specific requirements and ensure compliance with Thai legal procedures.

yes i got married in Bangkok to my wife who is from the UK she went back five years ago and I have two options bring her back and get divorced or go to the courts and claim desertion both will be expensive so I will remain married to her at 74 i don't want all the hassle as I'm enjoying my freedom and we remain good friends which makes it so much easier
