I am surprised by ongoing talk of lawfare. The courts' job is to examine alleged criminal acts. Both prosecutor and defense lawyer can put up their evidence. If the defense is unable to show why anyone should not be tried, then all criminals could escape justice using this precedent. Victimless crimes may be an opinion but not a defense.
