As far as I can see most AN members think she shouldn't get anything. Which none of them claim is a 'legal opinion'.

Wow, up until this comment, I was agreeing with you... even so, this comment is correct... BUT, irrelevant, as he was comparing NZ and UK law... NOT thai law. He specifically compared Thai and UK law.

I hope the London high court awards her nothing except her deportation papers. The poor old sod mst have given her a fair bit of cabbage before he died because how else could she afford to pay for the air ticket to london and the bond she has to put up for the legal fees ??...or maybe she will pay the lawyers fees in kind..on her back.

Can`t see how she even has a leg to stand on though - no written proofs or contracts , and a " common law wife " has no meaning in English law . Besides , she got the house , what more does she want ? I thought at first this was a challenge of the will. It is extremely unlikely that would be a no win no fee basis. No win no fee are generally for accident claims where there is an almost certainty of winning. But given the case is against the sons may be. But with no win no fee in the event of a win after fees there is very little for the plaintif.

There must be thousands of Thai women in a similar situation, who's husbands simply just never got round to updating their wills, which is not the sort of thing that rushes to the front of ones mind when one might be enjoying a late life burst of happiness or romance. Let the courts decide and keep the Thai bashing to yourselves My first thoughts but she is not contesting the will. She is going after the two sons. So even more bizarre.

It mentions a "rift" and she urged "his return".

He specifically said "Thai laws don't stand up in NZ, so probably won't in England" so was clearly comparing what wouldn't stand up in NZ, and probably won't in UK law..... mate, you seem to have trouble understanding simple English, comprehension is not your strongest point. I know your ego doesn't not allow you to admit your wrong, so I will leave it up to all readers to draw their own conclusion... have a nice day... this is all I have to say, on this topic. 2

Samh Posted Wednesday at 10:04 AM Posted Wednesday at 10:04 AM I hope she has been made aware of English law. If she is offered a sum before going to court but she rejects it but then the amount offered is less than the amount the court finally offer then she gets the lower amount. BUT she has to pay her own costs. If the two sons are savvy they will make a generous offer. If she gets awarded less then she pays her costs. So wont be left with much. If she loses then she pays her costs and the son's costs.
kickstart Posted Wednesday at 11:45 AM Posted Wednesday at 11:45 AM I looked at 3 words, high court barister, those costs are going to make big hole in 400k, she must been told that and she still wants to go on with the case, gold digger.

Many say, "when I die, she gets the condo." Or, "when I die, she get the 800k baht extension money." Just imagine for one moment she is successful in this legal action. The word will spread all over Thailand and then your children's inheritance is up for grabs. It would not be the first time of have seen one's wealth redistributed to a village / Thai family in Issan.
persimmon Posted Wednesday at 02:22 PM Posted Wednesday at 02:22 PM Not claiming to be an expert here , but I think the divorce laws are different in the UK and Thailand . In the UK , all assets are taken into consideration , whilst in TH , assets accumulated before marriage are not considered . in any divorce settlement.

Not necessarily, High Court is just the name of the court. In England and Wales there are 2 courts that rank higher than the High Court.
