To visit family residing in Thailand (less than 60 days) is in the Tourist section of the Official Website of Thailand Electronic Visa.

Does this mean that I am eligibly for Visa Exemption?

 

I plan to only come to Thailand twice this year staying around 40 days at a time. Previously I had the Multi Entry Non-O Married Visa which has expired. (Australian Passport).

You are eligible for "visa exempt" due to having an Australian passport.

No need to bring up "visiting family" to get this.

At the moment, this appears to be a 60 day visa.

Entry by air twice in one year should not be a problem.

OP, You can enter Thailand visa exempt and receive a 60 day stamp.

 

Be aware that airline at departure may ask for an onward/return flight.

My guess is that with the short visit (eg 40 days) you will have a return ticket.

Note: Jetstar almost always require flight out of Thailand..
