To visit family residing in Thailand (less than 60 days) is in the Tourist section of the Official Website of Thailand Electronic Visa.

Does this mean that I am eligibly for Visa Exemption?

I plan to only come to Thailand twice this year staying around 40 days at a time. Previously I had the Multi Entry Non-O Married Visa which has expired. (Australian Passport).

You are eligible for "visa exempt" due to having an Australian passport.

No need to bring up "visiting family" to get this.

At the moment, this appears to be a 60 day visa.

Entry by air twice in one year should not be a problem.

He's only staying for 40 days and a Visa exempt will give him that

Exactly and he specifically mentioned Twice per year.

Visa exempt entry perfect for his needs.
