I in Thailand , on an O visa retirement. visa will expire on the 25 May immigration could not ok the visa . (My fault)immigration told me to leave thailand before expire date then return to thailand once the visa expires.Than apply for a 90 day visa. Note worthy to mention the immigration staff were friendly and professional.

 

so my question is do I need in&out permit as this will also expired with visa . Do I need a in&out permit on my return ?

No. Your permission to stay and reentry permit both expire on the same day. So you leave, re enter after 25 May and start over.  If you re-enter visa exempt you apply for a single nonO at immigration. Alternatively you can apply for the nonO wherever you go to. Then you go through the extension process again

Sounds like for some reason immigration wants you to start the visa process from there beginning, therefore telling you to go out of Thailand and come back on visa exempt or tourist visa (depends on your nationality).

You don't have to wait for the visa to expire, just go out of Thailand WITHOUT a re-entry stamp, and when you get back just go to immigration and convert your permission to stay (that you were stamped in) to retirement, but make sure you have all documents ready.

It's not clear that the OP does not currently have have a reentry permit. 

Read first reply from upnotover. 

 

If he does he would need to reenter after it expires. 

BTW the OP does not have a Visa, that expired long ago.

He failed the financial requirement, in error.

Would be "financial non compliance" hence the OP comment..."my fault"

You don't have a visa, you have permission of stay until 25th May, which is a permit.
Your re-entry permit expires the same day as your permission of stay.

 

You need to depart Thailand by 25th May, then re-enter after 25th May visa exempt (without a visa), or apply to obtain a new Non O visa at a local Thai Embassy.

If you enter VE, you can alternatively apply for the Non O at Immigration, then the 1-year annual extension.

Basically, you have to start from scratch again because you failed to meet the financial requirements for a further 1 year extension.
