Achong and Anusorn, involved in illegal gold mining operations, have been sentenced by the Thong Pha Phum Provincial Court to five years in prison and fined 500,000 baht each. The charges arise from unauthorised activities within national park lands and protected forest areas.

 

Their illegal operations took place in Thong Pha Phum National Park and the Khao Chang Phueak National Reserved Forest, affecting 14 rai and 1 square wah. They violated the Forest Act, National Reserved Forest Act, and the National Park Act through their clandestine excavation efforts.

 

The court identified their actions as destructive, noting that the excavation involved clearing and occupying forest land for personal profit. This exploitation resulted in significant environmental harm, prompting prosecution under section 90 of the Criminal Code.

 

Upon being found guilty, both Achong and Anusorn faced a five-year imprisonment sentence. However, their admissions of guilt contributed to a reduced sentence of three years for each, in accordance with section 78 of the Criminal Code, which accounts for cooperation in proceedings.

 

Beyond prison terms, the court mandated the defendants to compensate the Department of National Parks, Wildlife and Plant Conservation with 560,100 baht (approximately US$17,255) in damages. This sum will accrue a 5% annual interest rate until the full amount is settled, reflecting the economic impact and ecological restoration costs.

 

Their conviction serves as a significant legal precedent, highlighting the stringent measures enforced against those who encroach upon and damage protected ecological zones. Authorities and environmental advocates alike stress the importance of preserving Thailand’s natural heritage, reminding the public of the consequences of illegal exploitation.

 

The case underscores ongoing efforts by law enforcement and conservation agencies to monitor and protect critical environmental areas from illegal activities and to ensure that violations are met with appropriate legal action.
