Bangkok Court Orders BMA to Pay 11 Billion Baht to BTSC

The Central Administrative Court has mandated the Bangkok Metropolitan Administration (BMA) and Krung Thep Thanakom Co Ltd to settle 11 billion baht in unpaid fees with Bangkok Mass Transit System Public Company Limited (BTSC). This payment, concerning operation and maintenance (O&M) services between June 2021 and October 2022, must be resolved within 180 days, including interest. The judgment relates to contractual obligations for managing the BTS Skytrain Green Line's first and second extensions.

 

Background to this legal decision stems from unresolved debts by the BMA despite a previous Supreme Administrative Court directive that required settling 37 billion baht. BTSC Chief Executive Surapong Laoha-Unya highlighted additional sums outstanding: 12.61 billion baht for services from June 2021 to October 2022, 17.60 billion baht from November 2021 to December 2024, and 3.70 billion baht from January to May 2025. The Nation reported that due to a lack of involvement in the original contract, the BMA has hesitated to issue payments without court orders, possibly to avoid legal liabilities.

 

The court's decision boosted BTS Group Holdings Public Company Limited's stock performance, with shares rising by 3.27% this morning to close at 3.16 baht, reflecting positive market sentiment. In a related transit update, Bangkok’s Red and Purple metro lines will discontinue the 20-baht flat fare, a pilot scheme ending as the Bhumjaithai administration steps in. This scheme initially launched in October 2023 under the previous Pheu Thai government aimed to cap fares but will revert to standard rates from October onwards.

 

Looking forward, BMA officials, alongside Governor Chadchart Sittipunt, are set to deliberate on an appeal against the court’s ruling. Such a move could increase financial liabilities due to potential extra interest. Passengers using the Red and Purple metro lines will see changes in fare structure from October 1, marking a return to pre-existing pricing.
