Supreme Court: "Simple Rape" Term Minimizes Crime's Seriousness

The Supreme Court has ruled that the crime of "rape" should be referred to simply as "rape," discarding the term "simple rape" as inappropriate. In a decision on July 9, 2025, the court's Third Division clarified that using qualifying terms downplays the severity of the crime and desensitizes its impact. This decision arose during the court's affirmation of a conviction for the rape of a 13-year-old girl.

 

Previously, both the Regional Trial Court and the Court of Appeals used the term "simple rape." The Supreme Court flagged this as both incorrect and potentially harmful, emphasizing that rape should be recognized solely under Article 266-A of the Revised Penal Code, which categorizes it distinctly. The court revisited the evolution of rape in Philippine law, highlighting the shift from a crime against chastity to a crime against persons, following the Anti-Rape Law of 1997.

 

This reclassification places rape alongside serious offenses like homicide and murder, underscoring its grave impact on the victim’s physical and psychological well-being. The court stressed the importance of maintaining the severity and gravity of the crime in its legal terminology, reinforcing that rape should never be trivialized or softened by qualifiers in judicial decisions, reported PhilStar.

It's "petite" crime, not "petty" crime, but it's pronounced like and has the same meaning as "petty." This has confused me, too.
