Diddy Seeks Release as Appeal Challenges Prostitution Conviction

Sean “Diddy” Combs has asked a federal appeals court to release him from prison and overturn his conviction on two prostitution-related counts, marking the latest move in a long-running legal battle. In an expedited appeal filed with the Second Circuit Court of Appeals, Combs’ legal team argues that his 50-month sentence is unlawful and that the conduct underlying the convictions should not have been treated as criminal.

 

Attorney Alexandra Shapiro described the sentence as unconstitutional and urged the court to vacate the conviction outright. If the panel declines to do so, the defense is asking for resentencing, contending that the trial judge misapplied federal sentencing guidelines. Prosecutors from the Southern District of New York, which handled the case, declined to comment on the appeal.

 

Combs was tried earlier this year in a closely watched federal case. Jurors heard testimony from two former partners—singer Cassie Ventura and another woman identified as “Jane Doe”—who described abusive relationships and coercion. While the jury acquitted Combs of the most serious allegations, including racketeering conspiracy and sex trafficking, it convicted him on two counts of transportation to engage in prostitution under the Mann Act.

 

Ahead of sentencing, Combs sought a reduced term that would have amounted to time served. Prosecutors countered by requesting a sentence of at least 11 years. U.S. District Judge Arun Subramanian ultimately imposed a sentence of just over four years, saying that Combs’ past charitable work could not outweigh the severity of the conduct proven at trial.

 

In the appeal, Combs’ lawyers argue the judge improperly considered conduct tied to charges on which the jury acquitted him, calling the punishment excessive. Combs also faces numerous civil lawsuits alleging sexual misconduct, claims his representatives continue to deny as the appeals process moves forward.
