Hi Everyone

I would also like to ask a question, My wife is in the uk on a 2 year settlement visa and is three months pregnant she also has a 8 year old daughter we want to bring to live with us so we can all be together, i had problems with my wifes visa as i am a self empoyed taxi driver and i did not give enough documention about my work so i was refused i later sent the evidece they asked for so it did not go to appeal but the whole process was delayed by about 3 months and was a traumatic time i just wondered if it would be any easier now that my wife is here and pregnant and wants to be reunited with her daughter

I've split your post from the other topic for the sake of clarity.

In applying for your step-daughter to come to the UK, other factors come in to play as she will have to qualify under a different paragraph of the Immigration Rules. You have to meet the same maintenance and accommodation requirements, but your wife will also have to demonstrate that it is she who has responsibility for her daughter's welfare. Who does she live with now?

Nice photo, Jason, although neither your missus nor the bloke to her right looks too impressed by your singing. :o I've no objection to the photo being there, but if you're worried about privacy (after all, it gives your name), just tip me the wink and I'll remove it.

she lives with her grandma now in si sa ket she has never seen her father since she was 2 she is 8 now will the father have to sign for her to leave thailand

Your wife will need to have some form of sole custody document from either a court or the district office in order to get the young girl a passport in the first place. When it comes to applying for the visa, your wife will have to show that she provides the direction in her daughter's life; i.e. she tells the grandmother what she wants to be done in respect of the daughter, and that she is financially and emotionally responsible for her. She can also show to the embassy any sole custody document which she has.

Thanks for that scouse, i spoke to wandee and she said it wont be a problem she can go to the district office and sort that plus get guarentees fron the school and local authority........thanks again for a great sevice and great advice

Hi mate ......you gave me some advice months ago about my step daughter in Thailand.........somebody told me now you have to get the girls legal father to sign for his permission......also i am thinking of applying for family credit for the new baby.........but i don't want this to interfere with bringing ploy over...they might say if i need family credit i cant support another mouth............thanks for any advice

Hi Scouse and everyone else.My wife has 3 chidren in Thailand:1boy 15years,2 girls aged 6 years and 8 years.We wish to apply for settlement visas for the 2 young girls to go to the UK but wait for her son to finish school in Thailand next year before applying for his visa.My adviser in Bangkok says this could be grounds for refusal.I have Emailed the immigration office in Bangkok to ask if this is so but have had no reply.If anybody can advise me I would be very grateful.

Family credit/working tax credit would be claimed by you (Not your wife) and is yours by right as a taxpayer. As long as you are still working they can't say anything about it. You'll have to supply your wife's details on the application and she'll have to attend the local job centre/social security office to get an NI number. Her name is on the application too, but it's not her claiming 'public funds' in the way the immigration people look at it. As stated before, you'll need legal paperwork from the Thai courts/authorities saying your wife has sole custody and it would help if you've been making, and have proof of regular payments to her parents for the girls upkeep, as well as proof of contact via phone/email/letters.

See Chapter 14 - Settlement entry for children, paying particular attention to Para 14.5 - "Sole responsibility".

Where is your wife now? If she is applying for settlement at the same time as her daughters then, provided she has sole legal custody, it should be a formality. If she is accepted so will they be. However if she is already in the UK and you are applying for them to join her then sole responsibility comes into play.

Sole responsibility will definitely be an issue when her son applies.

The older the child and the longer the period of separation then the more sole responsibility is an issue.

NB, sole responsibility is not the same as sole custody. She needs to show both.
