i posted before about my thai gf's situation. I have moved on and am trying to bring her to ireland for a holiday. I am now thinking that because she is still currently married but seperated 2 years and has a UK marriage visa on her passport we can use the common travel area mentioned below to bring her to the Republic of Ireland without needing a holiday visa. Does any one have any knowledge of this area. I for instance am thinking a could bring her to the Belfast as this is the Uk and then drive down to my city as there is a common travel area between Uk and Ireland.

Common Travel Area

15. The United Kingdom, the Channel Islands, the Isle of Man and the Republic of Ireland collectively form a common travel area. A person who has been examined for the purpose of immigration control at the point at which he entered the area does not normally require leave to enter any other part of it. However certain persons subject to the Immigration (Control of Entry through the Republic of Ireland) Order 1972 (as amended) who enter the United Kingdom through the Republic of Ireland do require leave to enter. This includes:

(i) those who merely passed through the Republic of Ireland;

(ii) persons requiring visas;

(iii) persons who entered the Republic of Ireland unlawfully;

(iv) persons who are subject to directions given by the Secretary of State for their exclusion from the United Kingdom on the ground that their exclusion is conducive to the public good;

(v) persons who entered the Republic from the United Kingdom and Islands after entering there unlawfully or overstaying their leave.

Dave,

I think your plan to use your girlfriend's UK visa and enter Ireland across the land border is a non-starter.

Even though your girlfriend has a current UK visa, as a Thai citizen she also requires one for Ireland. If you were to simply slip across the border, she would be illegally in Ireland from the word go. Furthermore, her UK visa was issued on the basis that she was in a relationship with her husband and this is evidently no longer the case, so its validity has been removed. Consequently, she runs the risk of being refused entry to the UK, meaning that she wouldn't even get ther opportunity to get as far as the emerald isle.

I'm afraid I have no in-depth knowledge of the Irish visa system. There are a few members on this forum who've been through the process, so lets hope one stops by and can explain the procedure.
