Hi everybody

Query: Is it Possible to get a 7 days extensions for a Non-Imm O visa

Here is my visa history:(Nationality-- Indian, Age 30)

  • Originally came to thailand on a 3 months Non Immigrant Otype visa
  • Extended the visa for one year based on employment
  • Did two more One year Extensions

My last extension was valid till march 2009. Unfortunately something went wrong between me and my employer.lost job in september.I returned the workpermit and went to India, came back with a new 3 months Non-immigrant O visa. And the last day of stay is January 2nd 2009.

Now I found a new employer.He is willing to apply for work permit for me.So I can apply for a one year extension based on work permit.The problem is he have to increase the company's capital for hiring one more foreigner(they have one foreigner working for them as of now).This will take some time and the whole process will not finish before january 2nd and may take 3-4 days more.

So I would like to know if its possible to apply for a 7 days extension.So that ,even if the process of raising the capital is not finished by january 2nd, I can still have enough time to apply for work permit after getting the company papers and get extension based on that...thus avoiding a journey outside which will be tough at this point of time

A 7 day extension on a non-immigrant is possible, but not often given. In your case you might get one if you show a letter from your boss explaining that he needs a few more days to get their paperwork in order to apply for a WP and extension based on employement. Nothing is sure however.

Hopefully I will get a 7 days extension.Also i read somewhere else in the board, that if you are having a thai wife or having children, i can get a 60 days extension(I am having thai wife-- minus the 400,000/40,000 requirement.hence the extension based on work permit)...Tomorrow I am visiting immigration office. Will update the status once i know the ddetails

You failed to mention you had a Thai wife. Yes you can get a 60 day extension.

Why did you leave after you lost your job. Your extension was based upon marriage not having a job.

Yeah I missed that..But my previous 1 year extensions were based on empoyment, even though I was on Non-Imm O visa based on marriage to thai wife. Since the extension was based on workpermit, once the work permit is cancelled the extension also becomes null and i have to leave the country. and hence I left.

Anyway today I went to Immigration office in bangkok and the whole place was swarming with people.The information counter officers weren't much of a help. The minute I said extension for Non-Imm O visa, they concluded it was 1 year extension and handed me over the TM 7 form. When i mentioned, i need a 60 days extension based on marriage to thai wife.. he said there is no such extension and only one year extension and asked me to enquire at room 1. At room 1, the small info desk was handled by university students and when I mentioned about 60 days extension, i got blank stares and finally she admitted, she dont know the details about 60 days extension as well as 7 days extension.Back to info desk in main room.

Now i mentioned about 7 days extension. He said it was possible , but today not possible as lot of people. So details about 60 days extension is still blurred. Maybe next week i will go there and try to do the extension and before doing that I will once again enquire if 60 days extension is possible ..

will update once I get a result

The 60-day extension is intended as an extension of the 90-day permission to stay you receive when you enter Thailand with a non-immigrant visa (clause 2.24 of Police Order 777/2551). In your case you are currently on a permission to stay based on an annual extension for work so it seems that the clause regarding the 60-day extension to visit Thai wife does not apply to you.

UbonJoe/Maestro: You two understand these confusing regulartions better than me. My passport shows a string of 1-year retirement visas up to Nov 07 when I went to Vietnam for a year. I returned this month on a 90-day non-O visa out of Thai Embassy, Hanoi. According to the above I would appear to be able to get a 60-day extention on that when it expires 3 March as I am, indeed, visiting my wife. My passport is stamped saying I have a Thai wife. I would wish to avoid Suan Phluu and, living in Isaan, usually go to Gap Chern. Can I do that, do you think, and do I read you aright that I can get the 60-days extention from Gap Chern? They may not know about it or they may be restricted in what they can offer(?)

Any immigration office should be able to do it. It is not a new rule it was in the old police order. Just tell them it is to visit your wife.

You will need a copy of your marriage certificate.

Yes, I missed that part about the OP’s last arrival in Thailand having been with a single-entry non-O visa. So he is good for the 60-day extension to visit his Thai wife and as you say he should be able to get it from the nearest immigration office.

Hi All

Good News. I went there yesterday and got the 60 days extension without much hassle.Thank you Ubon and Maestro for the valuable info and the links.You guys are doing a wonderful job. I took a printout of the police order both thai and english, just in case, if the officer say its not possible, i planned to show the clause for the 60 days extension in the order.

I went there quite early and outside the office it was already full of people in queue. At the information counter, the officer was bit confused when he saw my Tm7 and he discussed with a fellow officer and then gave me a ticket and went to room 101. I took my wife with me.I let her do the talking with the immigration officer as the communication would be clearer. But it backfired. After wife explained,I guess the officer said.. i have to go to another counter for extension based on work permit. Probably the officer misunderstood that I want to extend based on workpermit. Then I explained in english that i wanted 60 days extension with the details,She said its possible and finally got the extension within 5-10 minutes

So Euca, you should probably get it without any problem. Maybe you can also take a printout of the police order and in case,the officer is confused you can show it to him/her(politely... without making him lose of face or anything like that..lol)

Sorry to gate crash this thread but i have a question relating to title of this thread....

My Non 'O' is due for renewal on the 10th Jan 2009 but i will be flying back home on the 18th. Can i just get a 7 day extension at the immigration centre or do i need to do another visa run which will give me 90 more days of which i would only use 8 days?

Immigration is normally reluctant to give 7 day extensions. Since you have a multiple entry visa they may just tell you to do a border run.

A 7 day extension still makes you short a day. So thats 1 day overstay.

I suggest a border run. You can make it any time you want between now and the 10th since you will get 90 days anyway.

An extension of 7 days will still leave you short. Yo could try to get an extension and pay the overstay fine at the same time. Do take the ticket with you when you visit immigration, to comfirm you will be realy leaving the 18th.

If you near a border, just do a border run and get 15 days.

Further to kingscliff's post............is the general view that a 7 day extension to a non imm o (multiple) wont be given then?

I/m in a similar position,

90 days will be up 27th April (due to do a run 28th Jan)............i would normally head back to the UK and apply for a new visa but i have family here on holiday who are travelling home 3rd May. I would prefer to go back with them ,so a 7 day extension would cover the period 27th April to 3rd May.

No Thai Wife/Under 50......located in Pattaya.

Would rather not drag myself to the border for the sake of a few days.

Any Thoughts?

You can go to immigration and ask/try. If you have a ticket out that might help.

They can do the extension if they want to but if they will or not I cannot answer.
