My wife and I thinking about moving back to Oz some times in the future the question is

1. my wife is a PR of Australia but has been out of the contry for over 1 year does she need a

re entry visa to enter Australia again?

2. our nephew like to follow us and study in Australia, what is the minimum age to optain

a studend ( education visa ) and what other conditions are attached to apply for one?

I hope some one can point me in the right direction

In relation to the first issue, I wrote about that a few days ago under another Thai Visa topic within this forum. I will just 'cut and paste' it below here now though:

Re-entry facility or a 'return facility'

When a person is granted permanent residence, such as a spouse visa, the permanent visa gives them permission to live in Australia indefinitely. However, the permission that a permanent residence visa gives to the holder to travel and enter Australia is limited to a number of years (usually 5 years) from the date of the visa grant. This permission to re-enter Australia on a visa is sometimes known as a 're-entry facility' or a 'return facility'. Once the re-entry facility expires, the visa holder needs to obtain a Resident Return visa in order to travel and enter Australia.

When did you wife obtain her PR visa? Her visa label should indicate when the re-entry facility expires.

Student Visas

You didn't say hold old your nephew was, but I am assuming he is under 18.

For student visa applicants who are under 18 years of age, the following is required:

1. They must declare in their visa application that they will be residing in Australia with;

a parent or custodian; or

a relative (nominated by the student's parent/custodian) who is at least 21 years

old and of good character

Form 157A provides for a parent/custodian to nominate a relative 21 years or older with the student will reside in Australia.
