To all experts in visa rules, :o

I am going to present my scenario.

I just got a fresh Single Entry, non-Immigrant Class B visa stamp from the Thai Consulate in Vientiane on March 20, 2009 with the help of the documents from my employer.

I entered Thailand on March 21 by using the Class B visa, and I was glad to receive 90 days stay stamp (visa will end on June 21). But unfortunately yesterday, I have a fight with my employer for some reasons and I told them that I am quitting the job. Now, they are threatening that they would cancel the Class B visa if I leave the school employer.

The question is:

1. Can employer cancel the non-Immigrant Class B visa?

P.S. I never had any work permit before until now.

No, they can not. Only when you are on an extension of stay from immigration it would be cancelled when you leave your job. You are not on an extension of stay and your non-B and permission to stay remains valid.

Nope, they cannot cancel the visa.

The only thing an employer can do is if an employee stays in Thailand on a 1 year extension (so beyond the initial 90 days) based on employment/WP, then cancel the work permit which will automatically cancel your extension of stay.

But a visa, issued by an embassy or consulate cannot simply be canceled by your employer.

Your Visa expired on the day you entered Thailand.

You now have a 90 day permision to stay stamp. No. Your employer cannot do anything to cancell your 90 day stay.

Go tell your employer that you checked with immigrtaion and then give him the phone number to the head office in Bangkok and say that they would like to talk to him about his telling people he has the power to cancel visas.

If you bluff well you might get him to sweat a little.

so let me make sure I understand this perfectly :

if you are on your first year of a one-year non-immi B visa -- not on 'extension to stay' -- and you quit or lose your job, you are still entirely legal in Thailand for the remainder of that year?

or just for the remainder of the 3-month permit to stay stamp?

for example

--i have a multiple non-immi B visa that started Nov. 1st, expires Oct 1st.

--my current stamp says I'm valid until May 31st, 2009.

--i leave my job tomorrow, and my work permit expires.

if i take a weekend trip next weekend, will I be granted the usual three-month stay upon my return to Thailand (which I could repeat until my original non-immi B visa runs out)?

or am i only good for the remainder of the current 3 month stamp?

As long as you have the visa and immigration allows you in you are fine. Immigration always has the final say at the gate - but in most cases having the visa will be the determining factor on what they do.

so how would immigration know whether the visa is still tied to a valid work permit, or not? is there some communication between immigration and the work permit office? (I.e., if my employer issues the termination letter, will the guys at passport control know this)?

also -- i'm wondering if i would technically be legal or not?

it seems there is a difference between extensions of stay based on work permits, and extensions based on multiple entries (in my case, i've gotten multiple 3-month stamps on my multi immi b visa). if the extension to stay is based on the work permit, it is void when the work permit is cancelled. if it is not based on the work permit (but on the three-month entry stamps), is it still cancelled?

or: do i need to go in and cancel my visa in person when i terminate employment, or can i stay out the visa?

wondering if it is legal to stay out the visa, basically.

more specifically, i guess i am wondering about the new work permit cancellation rules --

you no longer need to turn in your work permit (your employer just issues a letter of termination)

but you are supposed to go to the office in person to cancel your own visa, is that right?

Only when you are on an extension of stay from immigration do you need to go to immigration to cancel your visa, which you also do if you just leave the country the same day.

When you are on your initial permission of stay our have a valid multiple non-B there is no need to go to immigration or leave the country.

good news! thanks!

one last small question: i have a valid multiple B, still good 'til october. can i continue leaving and entering on 3-month stamps until the visa is up (after my work permit has been terminated), or do i only have the remainder of the last three month stamp?

it sounds like the visa should be good until it expires (since i've never dealt with immigration for any extensions), from what you said -- just want to make sure!

Your visa remains valid, meaning you can just leave and re-enter the country to get a new 90 day permission to stay.

Remember that when you leave and re-enter just before the visa expires you will get a new 90 days, so you can extend it to almost 15 months.

Very important the above. Do a border run the day before the Visa expires and you will get another 90 days.
