Hi,

Wonder if anyone can help.

My friend has a 1 year O visa (not married) which was attained from his job as a teacher where he has give three years of sterling service.

He has now received a better offer (not in teaching) and wishes to leave his present job but still has 10 months validity.

My question is - Can the employer cancel his Visa?

Any feedback much appreciated

It sounds like he has an extension of stay not a visa. If that is the case then on the date his job ends his extension ends.

The employer does not cancel it. What happens is his employer writes a letter stating the date that the job has ended and if it is given or shown to immigration the extension ends on that date. If he can get the new job set up with a work pemit and documentation he can go to immigration on the date that his job ends and get a new extension. If not then he has to leave the country on that date or get a 7 day extension from immigration.

If was to do nothing and later go to immigration to get an extension based upon documentation from his new job he would have to pay an overstay fine from the date his old job ended.

If he had a multiple entry visa then it would not be a problem because a visa entry would not be canceled. He could stay and just keep using the visa until it expired.
