hello.

I am french, my boy friend is Burmese and just get work permit but I suppose only allowed to stay in Mae Sot. We already have baby and he need to declare him to french embassy as the father.What is the process to be allowed to go to Bangkok. Does someone know and can help me in any information? Thank you.

Except for the fact Rangoon is not in Thailand and I suspect the child was born in Thailand and the paperwork will be Thai and most likely can only be processed by the French Embassy in Thailand. She appears to know what is required but not how he can travel to Bangkok to comply.

Why don't you call the French Embassy in Bangkok and ask for advice and guidance. They are surely in the best position to help you as one of their citizens. Details of Myanmar Embassy in Bangkok also included in case you need to liase with them too on travel arrangements for your boyfriend. Good luck.

I just noticed that you are not married, that means that your BF might not have legitimised the child under Thai law. The child is only legitimised under Thai law if the father registers the birtth of the baby himself!

Maybe the birth is not yet registered which is why they want to go to Bangkok?

Mario: saw your excellent article on the above the other day. Is there a time limit for registering the birth in Thailand. This may be useful information for the OP.

Well as you may not know, the kid can be registered in any French Embassy.

The fact that the paperwork is in Thai is irrelevant as that can be translated in Rangoon

The important thing, it seems, is that the boy is registered

Be carefully what you do , the Thais are having a clear out of Burmese, there are to many in Thailand i read some thing like 300,000 in Bangkok and surrounding areas, make shore your paperwork is up to date,as for your baby he will not be regarded as a Thai. I do not know for Certain but your son will not be classed as French.Hope you find a solution best wishes to your family. Go on line and google the French Embasy Bangkok you should be able to get all the infomation you need ,

No I do not know that or I would not have posted above; but as the birth was in Thailand and the foreigner has no status in Burma so not in there jurisdiction I highly suspect they will say use the Embassy in the country involved.

Being born of a French mother would make the child French I presumme. The legitimisation by the father will recognise the father as the child parent, and might serve to give the child also Burmeese nationality.

The OP needs to have the birth registered with the local hospital or doctor and officialise it with the French Embassy

But tI guess we are on the wrong track as the OP wants to know how her bf can reach Bangkok

The child was born in Thailand and thus the birth has to be registered with the Thai government, which is done by registering the birth at the local amphur.

Going to the french embassy serves two purposes here:

1. notifying the French government of the birth of a French citizen

2. legitimising the child by the fahter under French law

For his question the Op can better contatc a local NGO.

I suggest contacting the BBC (Burmese Border Consortium), just google them on internet.

When the mother is married, the law will asume that the husband is the father of the child. In the OP' case she is not married, so the law can't make a presumption who the father is. To be recognised as the father he has to declare he is indeed the father. That act of declaring you are the father of the child is called legitimising. In Thailand that is done by having the father registering the birth himself at the amphur.

So only when you are not marreid do you need to legitimise a child.

Under Thai law, if you are named on the birth certificate, you also legitimise the child if you later marry the mother. So if the birth was in Thailand and you married later in Thailand you have nothing to worry.

Not 100% sure about US law, but as he has a US passport etc I would say you also have legitimised him under US law.

Thanks all for your reply. Impossible to go back to Burma. Baby will be french, just too small to travel right now. Problem is for the father, how to be allowed to leave Mae Sot, go to Bangkok, declare his baby at embassy and be married. That all, how to be allowed to move!!!!????

Like I said above, contact one of the many NGO's in Mae Sod, just google Burmese Border Consortium.

As for the marriage, that might be a problem as Burma doesn't aprove of its citizens getting married to foreigners. Again an NGO such as the BBC can give you information on this point.

The hospital has to fill in a paper and they should mention him has the father.

That paper is used to register at the Amphur. The name of the father should be mentioned on the birth certificate and signed by the father at the Amphur.

I my case the person at the Amphur refused to give the child my family name because I was not married to the mother at that moment. (we did not want to marry because we wanted to buy a house in her name)

This is (was) not a legal requirment but that women at the amphur wanted it her way (b.tch).

About 2 weeks later we married and the birth certificate was issued right (a couple minutes) after that.

The embassy need the translated paperwork, they do not need to see the father or in my case the mother and the baby.

If he is not mentioned on the brith certificate as the father or did not sign, your Embassy may ask you to start a complete different procedure.
