Is the rule of not staying in Thailand more than 90-Days in 6-months still valid?

I have been here for about 8+ months on a non-immigrant visa and need to fly out tomorrow AM due to an emergency. My 90-day reporting / extension of visa is actually due today but I don't have time to get this done today at immigration or get a re-entry permit.

This is all kind of last minute and hoping I can get back into the country on a 30-day Visa Exempt Entry in a short time and then see about getting my visa fixed or worst case applying for a new one.

Thanks for any knowledge you can share on this.

PS- It is also my understanding there is no fine for overstaying one day but am hoping the same applies for not reporting to immigrations since all is due today. *If it matters, I am on an EDU Visa.

No, not used anymore. In any case this only applied to time in Thailand without a visa, i.e. time spent in Thailand on visa exempt entry stamps.

Thanks! I read this on the forum but was surprised to see it since I meet so many folks who still believe it is true.

Any clue if I will be able to come back and reinstate my EDU Visa since I am leaving without a re-entry permit (it was single entry) and am not doing my 90-day update today at immigration?

And lastly they say there is up to a 5,000 bhat fine for not reporting (90-day) address today. Any clue if this also has a 1-day grace period as does over extending your day by 1-day? I am litrally going to be staying 7-hours late but would prefer not to take 5k "bhat" if I don't have to.

No, you had one entry, and you used it!

Only solution would be to extend for 90 days and get a re-entry permit on that new extension.

And lastly they say there is up to a 5,000 bhat fine for not reporting (90-day) address today.

Fine would be 2000 Baht I think, and anyway, the 90 day address reporting has a window of 7 days before till 7 days after the due date.

The fine for overstaying your allowed to stay stamp is 500 Baht per day, but if leaving by air the first day is waived. You do get a little stamp in your passport but this has no influence on subsequent stays/visa applications.

If you leave by land you have to pay the 500 Baht fine from day one!

Again Thanks! And hate to be a pain but it sounds like you are saying I don't have to worry about the 90-day reporting fine either ... just want to clarify.

There is no window if he fails to report; as he intends to do. If they catch it there will be a 2,000 baht fine at the time of his next/first report after return.

And yes, you will need to obtain a new visa.

Oops, I stand corrected.

So you can be up to 7 days late reporting your address, but you have to do it.

Confused -- will I be fined at the airport? And if I need to get a new visa, why would I need to report on the old one? And are you saying there is no 7-day grace period?

And finally, if I make it to immigration at lunch time, think I can get this done? It is just so freaking frustrating because if I get over there I don't think I will have time to also get everything else done such as extending the EDU Visa (or is this the same as address reporting) and also get another re-entry permit.

Thanks, I am just so pressed for time today and everything is so freaking last minute.

See my above reply. I am confused. If there is a 7-day window then who is to say I won't be back in 7-days and if I need to get a new visa then I don't need to do the address thing for the old one. And again, we are talking about being one day off and I would think if I am giving up this current visa by not reporting then ..... maybe I am applying too much logic instead of Thai Logic.

I was just looking at my passport and what is odd is the Visa stamp in my passport says good until the 16th but it was a paper they stapled in my passport with the last receipt they have me that says the 15th. I wonder if this is because the 16th is a Saturday.

You will be fined on next reporting most likely - but they may not check close enough to see you departed after your report day. The window is for reporting - it does not mean you can stay longer than 90 days and fail to report.

90 day report can be done downtown at the new BOI office in about 10 minutes. About the same time at Chiang Wattana. But 12-1300 is lunch hour.

Visa has nothing to do with you if on extension of stay - there should be permitted to stay until date stamp for that and that is what is important for stay.

The 90 day report is not normally the same date and you should have a paper receipt that has a date for reporting on it.

Remember on a 90 day report it starts on day of report. On an extension of stay it starts at the end of your current extension of stay.

Thanks Guys!

I would love to get the visa stuff taking care of but it is a matter of priorities today and I have got a ton to accomplish at home. The new immigration office is an hour+ away and would just hate getting over there and only being able to take care of the reporting and not re-entry. Although it sucks am going to have to deal with crap when I get back, a concern I had was if I was going to be hassled at the airport and need to bring Thai money to pay any fines.
