If you have sole custody over a Thai national you can apply for a 1 year extension of stay if you have an income of 40,000 a month OR 400,000 in a bankaccount in Thailand for at least 2 months. (money can come from abroad).

If not you can get a 60 day extension from immigration with documents proving you have sole custody oevr your child and he lives with you. Take the kid with you.

Any extension can be asked in the last 30 days of your current permission to stay and starts when you current permisson to stay ends.

1. You must apply for the 60 day extension before you current permitted to stay ends - best to do in next week or so. You will require proof of marriage and expect they want to see the wife.

2. You require 40k income proof or 400k in bank account for 2 months to extend your stay on basis of marriage or child. A work permit does not mean you can extend your stay.

A single entry non immigrant O visa is normally available without the need for 40k income - if you have the income proof and custody of child an extension of stay from Immigration may be available for one year at a time. There is also a 60 day extension of stay available without the need for income proof.

The rule for needing to be 50 years or older changed Nov. 2008. Now there is no minimum age any more.
