Hi All,

Just had a very frustrating conversation with the admin girl at my office, and was hoping some of the Guru's on here may be able to help clarify.

My situation: I have a multi entry 1 year Non Imm B issued in UK, expires 20/05/10. Work permit expires 06/06/10 (had for 1 year). Latest permission to stay stamp expires 28/06/10.

We are going to immigration to apply for an extension of stay based on my work permit tomorrow. She tells me that my existing permission to stay and visa will be cancelled, and I will be issued with a 1 month 'visa' stamp whilst my application is under review. I say hogwash as my visa is still valid until 20/05, moreover my permission to stay is more than 2 months hence.

The problem is I will be leaving the country at least twice in the next month, so she is trying to tell me I need a multiple re-entry permit to cover the following month, and then apply for another multiple re-entry when I get my 1 year extension in 1 months time!

My theory is that she has done this before for people whose visas had expired but not for someone in my position. I will return from both trips before 20/05 so therefore should receive 90 days each time as per my multi entry non B, no?

I realise my approach is based on common sense and logic, so could be way off the mark, but they seriously couldn't be that silly, could they?

Once you apply for extension of stay you will receive the 30 day stamp and then the one year stamp. You can not use your visa for travel if you have an extension of stay as leaving without a re-entry permit invalidates the extension of stay. You either use visa entry or you use extension of stay and require re-entry permits for travel. Cost is 1,000 baht for single.

Your admin girl is correct. A new permission to stay invalidates the previous one.

Re-entry-permit fee: single 1,000 Baht, multiple 3,800 Baht.

Thanks guys for the responses, this has taken an even stranger turn now.

The girl went to immigration today to check that she had all the paperwork required for our visit tomorrow. Immi said that as my permission to stay is up to 28/06 they cannot process the extension until within 30 days of that date.

I am due overseas for a few trips and will return on the 10th May, meaning I will get a permission to stay up to 7th August. By the Immi officer's logic we will then not be able to apply until 9th July, meaning I will be unable to travel in the meantime as my visa will expire on the 20th May.

This seems nuts to me as I will need to travel in that period for sure. Also, can you even apply for an extension after your visa has expired? Sorry if these seem like silly questions but this is the first time I have done this.

Visa expiration has nothing to do with it - your permitted to stay is what is important. She should have told/shown immigration your travel plans as often they can do early if you have such a valid reason. But last 30 days of entry is the normal rule.

After 9 July should work for you.

Edit: It appears your girl did mention the travel and your return to get that 9 July date so it appears you have a very good lady.

Thanks Lopburi, that's one worry off my mind with regard to visa expiration.

The problem now then is that I will definitely need to travel outside the country, probably more than once, between 20th May and 9th July, but not sure of dates yet. Can I get some kind of re-entry permit on my permission to stay, as I will effectively have no visa then?

BTW you give my admin girl far too much credit, I worked those dates out for illustration purposes :)

I was surprised that she had done so but actually what she has told you is true which from most reports is not always the case.

You can get a normal re-entry permit for that travel and get the same permitted to stay until date that you currently have on return so it will not be a problem - just be sure to have the re-entry permit prior to travel. If dates are not firm get when you return - dates on form can be anything and would avoid a last minute trip with no time to obtain.
