the beach itself isn't private, but they do have an area near the hotel which I believe is for guests only, but I have sat there many times when I wasn't a guest. You do not need a license for fishing that I am aware of, but I understand it is very hard to catch anything near the hotel. You will see thais fishing off the rocks near the hotel.

Fishing? No license needed unless you want to catch big sharks and giant whales.

Unless you want to get to it from the road above you have to go through the resort & they might try to stop you knowing you are not a guest.

all beaches in Thailand are public, and the only beach with restricted access is the one outside kings residence in Hua Hin. even 500 meters of water is guarded in this location

However some land owners, like Meridien, denise the public to use their land to acces the beach, but it can still be accessed from the water

As said the beach is public. I have been there several times. I just dress nicely and bring a towel etc. in a small backpack and walk right through the resort.

Same here, I even drive my car thru on the way to Jungle Resort and guards never make issue out of it.
