Visa Help Needed Please

hi all, me and my wife will be applying for a tourist visa within the next 2 weeks and i need some advice on our situation please....

we have known each other for over a year now and i have spent almost 6 months on and off with her in thailand. i have been living in her parents home for the past 3 months along with her 3 year old daughter and her brother.

she is now 10 weeks pregnant and i would like to take her to england for 4-5 months to firstly see if she actually can and also to give her a better living environment whilst shes pregnant....

the babys due in august so i want to get a doctors letter stating she has to return to thailand as it wouldnt be safe to travel after being pregnant after6 or 7 months.

the house shes living in will be changed into her name when she turns 20 in june and 17 rye of land will be hers aswell in june.

unfortunately she works cash in hand so theres no way of showing a valid reason to return on the job front.....

so...im wondering if you think the land and her returning to have the baby will be enough to satisfy the "reason to return" requirement???

hopefully they can see that by her not returing to thailand would put not only our relationship in jeopardy but the babys aswell..

My lady only had about 3200baht in the bank so its not about money.Just put in your Sponcer letter that your wife loves Thailand and has a close family background, She earns a living of her land to support herself and family. You cannot see a problem in her returning to Thailand. I Am not certain about your girlfriend health issue, pregnant, I don't think it Will be a problem as long as she is not to far gone, they may ask to see some form of health Insurance though. You will get better advice latter when some of the professionals start to read your post , best of luck for you.

I think the 3 year old daughter is a very valid reason to return.

But...

Please remember (I presume) that your wife will not be entitled for free NHS treatment, including antenatal and child birth.

Insurance will probably be excessive if your wife declares she is pregnant, and "null en void" if she does not.

Airlines rules differ slightly but basically most will insist on a doctors note "Fitness to Fly" at about 28 weeks and airlines have a no fly rule for expectant mothers over 32-36 weeks, (you will have to pay for the note).

Assuming your wife gets a visa within a week or so and you can arrange travel in the next 3 weeks she will be 3 months pregnant, so any longer than 3 months in the UK may find your wife liable to hefty medical bills.

Alright mate.. I am in the same position as u, im trying 2 get a holiday visa for my thai girl also.. I spoke with a visa specialist who was recommended 2 me yesterday a guy whos office is in london i can give u his number if u want?? Some of the advice he gave me regardin a holiday visa was..

photos of the 2 of u together

reciepts from hotels/apartments u have stayed at together

Reason for your girl 2 return to thailand i.e a job or house or land which u already said she has

4 months bank statements from u showing u have funds to support her while she is in the uk

Explanation of how and were u met

Any evidence if u have been supporting her financially

That u have a house or some1 in ur family has a house u can stay in the uk

U are in much better position than i am with my girl, i think u would get the visa no problem.. Good luck fella

that number would be good ...ive got all the paper work done im just waiting on my dad to send a letter of invitation stating he will let us stay at his house.

Hi,

Me and my Thai wife live in England now and we are about to get another settlement visa as well for my step daughter.

couple of tips on submitting your application;

1) your sponsor letter should just be a story starting from the first day you met up to today - you will soon start filling the pages.

2) make sure your application is in a ring binder with plastic inserts for your documents

3) supply an index card for the front o the binder

4) keep your documents in a good order....application form, sponsor letter, copies of passports and your visa stamps, six months of your bank statements, photo's, emails and texts, pictures of the house in the uk.......nice and neat with a good index card.

A couple of points.

1) As she is under 21 she is too young to apply for settlement as your wife or partner.

2) She is pregnant with your child.

Both of these may cause the Entry Clearance Officer to suspect that she may not leave the UK at the end of her visit because she will want to stay with you. You have to produce convincing arguments to overcome these suspicions.

That she has a child already will not, by itself, be enough to overcome this. Many Thais work abroad leaving their children with relatives. Many also come to the UK and once established apply for their children to join them.

Stress in your sponsor's letter that you are aware that she cannot settle in the UK as your spouse or partner until she is 21. Add that you are aware that her overstaying a visit may jeopardise any future settlement application.

Also stress that you are aware that as a visitor she will not be entitled to NHS treatment and that she intends to return to Thailand for the birth.

That she will own land in the future is not a reason to return now, but mentioning this may help and certainly wont harm the application.

Having said all that, if you are living in Thailand with her and will be returning to Thailand after the visit then you will be her main reason to return; you will need to submit a copy of your passport showing your immigration status in Thailand with her application.

Up to you if you want to use an agent. The information Trainor3685 received from his agent could easily have been found, for free, by asking on here.

If you are going to use an agent, I recommend that you read this topic first; particularly if you are considering hiring an agent in Thailand.

As 7by7 say's having a chilled is on it's own probably well short of "reason to return" but would add weight, demonstrating a bond between mother and child is very important.

You do not state where you will be staying in the UK, obviously if you are staying with your family, as she is your wife she will need to complete form VAF1B (Family Visitor), or if you declare reason for visit is to meet family, actually I think this will be a better option as it gives a good reason for your visit and has a right of appeal should your wifes application be rejected.

I seem to disagree with 7by7 on: "2) She is pregnant with your child", please correct me if I am wrong, I see no question on the visitor visa application asking if the applicant is pregnant, BUT at port of entry if the immigration officer suspects that she is, she may be questioned and possibly refused entry or further conditions placed on the duration of her visit.

If you chose to, then you could well add to your sponsors letter that you have deliberately asked for a visa of certain duration in order that your gf will return to Thailand before her third trimester and ultimately give birth in Thailand. Will you be travelling back with her for the birth? Be sure to include this detail to, and even a short description of your plans for the event e.g. travel dates, where you will stay, how long you will stay, future plans for you, the gf and child, what hospital is she booked into, how much have you paid etc.

i have considered both options and it was a hard call but i think mentioning the baby will be 4 the best. weve got a doctors letter stating she will have to return to thailand to have the baby and also reccomends she returns the middle of june for it to be safe to fly whilst pregnant. good idea about giving the name of the hospital....i hope all thses little things will be taken into consideration

ill be travelling a month after her to save a bit more money before the baby comes.(also chelsea are playing thailand in bangkok so i have to come back]lol......but seriously, ill be back 3-4 weeks before the babys due.....ill be taking your advice and detailing this all in the sponsors letter
