It's quite clear that not all of Trump's policies are in accord with the Constitution, nor are they all legal. That's the precise reason why he keeps losing in court, as more and more judges are ruling his actions to be either unlawful, unconstitutional or both. Even the Supreme Court, despite being dominated by Republican nominees, has ruled against him on a couple of cases already (notably on tariffs, and in the Abrego Garcia case).
