Im staying in Thailand on a non immigration visa based on marriage and I am permitted to stay until 19th of June.

I planned on going to Immigration applying for a one year extension on 22nd of May (all paperwork is taken care of)..

How long does the extension of stay application take?

I have to go to the States around the 20th of June but I am not sure what date is best to book my ticket. I assume immigration will give me an extension of stay starting on June 19 and that I can leave the country right after that date with a reentry permit.. What I am worried about is - What happens if the application is not finished before I have to leave the Kingdom?

As far as I know they will give you an under consideration stamp and ask you to report back around 19th July for the result.

Per above, it will not be finished as it takes 30 days and recently members have even been told to return in 60 days.

You might want to apply a few days before the permission to stay ends, so around the 16th or so of June, that would give you 30 or even 60 days before you would have to be back. Don't forget to get a re-entry permit!

After your permit to stay ends and you go onto the under consideration stamp you are then in state of limbo meaning that you cannot leave the country or re-enter since your current re-entry permit will end on your current permit to stay date.

You will have to wait until you have the to new to permit to stay stamp done before you leave and get a new re-entry permit. If apply early for your extension you can then leave and re-enter up to your current permit to stay date.

A new re-entry permit for the under consideration period takes care of that minor difficulty.

AFAIK you can't get a re-entry permit for that period of time since you no longer have a valid permit to stay.

It doesnt matter if I apply on the 29th of May or the 15th of June, since I will get a "under consideration stamp" that is due 30 days after my current permit to stay (according to Lite Beer). If this is true then I will have to report back to immigration around the 18-19th of JULY for the result..

The stamp will put me in a state of Limbo, but I can get a new re-entry permit that is valid during my "under consideration" period..

If all above is correct, then I should be able to leave Thailand on the 22nd of June and come back on the 17th of July right (with a new re-entry permit)?

(I did not read Ubonjoes last post before posting this.. and now I got even more confused:))

I am waiting for one the forum mods to settle this. But I do believe I am correct unless something has changedwhile I was inactive on the forum.

If I am correct then your best option might be to get a 60 day extension to visit your wife and get a re-entry permit for that permit to stay created by that extension to make your trip and then get your one year extension before the 60 days ends. Unless you could make your trip earlier and go in on the 22nd as planed to get your extension and make a trip out using a re-entry permit returning before the 19th of June.

Personally I have seen no reports on this one way or the other.

I cannot see why this would not not be possible although the only sure way is to go and ask them.

For what it's worth, Phibun, Ubon Immigration just gave me the "under consideration" stamp for 45 days from the day I applied. They also had me do a new "receipt of notification" on the day I applied which told me to report back in 90 days. I also applied for a year extension based on marriage.

As stamp is a new permitted to stay date you should be able to obtain a re-entry permit for that date I believe - but have never done and not sure if new policy of the date being from current permitted to stay rather than from date of application might have an effect or not.

The report back date is not a permit to stay date so to me that means no re-entry permit can be issued. Plus if you make a trip and re-enter that will give you a new permit to stay date different from the one that you have already applied to extend so that new permit to stay would make your application that is under consideration void.

I recall this being discussed before and the consensus at that time was what I have already written.

I have not had such a stamp for ten years but at that time it was a normal permitted to stay stamp the same as you receive for any extension of stay with a stated date you could not remain beyond on it (at that time 45 days in the future).

You must of gone in about 15 days before your permit to stay date.

Making a 90 day report and getting a report back date in 90 days is normal because when they stamp your permit to stay after the 45 days it will 1 year from the your current permit to stay.

I have not had such a stamp for ten years but at that time it was a normal permitted to stay stamp the same as you receive for any extension of stay with a stated date you could not remain beyond on it (at that time 45 days in the future).

Here is a verbatim quote of my last report back stamp. Not clear enough to get good scan of it.

"UBONRATCHAITHANI IMMIGRATION OFFICE

APPLICATION OF STAY IS UNDER CONSIDERATION OF

THE IMMIGRATION BUREAU . APPLICANT MUST CONTACT

THIS OFFICE AGAIN ON 17 SEP 2011 "

Although the wording has changed it still allows your stay up to that date and suspect can be used to obtain a re-entry permit to that date. Just as a visa exempt or visa entry stamp can be used - the date being the key.

I don´t know what to get out of this discussion and I will not buy an airline ticket before I know exactly. No one seems to know for sure so I guess I have to go to Chaeng Watthana in hope of finding answers..

Thai immigration SERIOUSLY needs to get their act together! Between the one rule that means 20 different things and their backlog, it's getting to a farce. Jesus H man...maybe a little OT is due, while foreigners are sleeping!

Sorry we can't give you a firm answer. I plan on going to immigration in Phibun Monday or Tuesday for my 90 report and I will ask them about to it. I will post the answer after I get it.

Probably not much help but I remember when I applied for this the first time in Samui.

Seven years ago in the days when it took about 8 months for the decision.

Had to keep returning to Immigration every month and was given another 30 day under consideration stamp.

The Officer asked me if I intended leaving the Country during the period and I said No.

This would indicate to me that a Re Entry Permit was possible.

Especially in the days when it took months of hanging on.

It has been adviced in the past to get a re-entry permit if need to travel and never seen someone reporting back that a re-entry permit was not possible while under consideration.

I can confirm, I just renewed mine, and was told to return in 60 days.

Just got back from Phibun another quick 90 day report finished.

Good news is that you can get a re-entry permit that will cover the period of waiting for approval. This coming from new Lady that is head of office (speaks better English than previous one). She did make the point that you have to return by the report back date.

That is as I always have understood it to be.

You can get a re-entry permit, but it is only good for the under consideration period and you have to be back on the date you are told to come back for the 1 year extension.
